I think too many people spout the party line bullshit without thinking first.

Roe needs overruled. It's crap, from a crap bunch of assholes who couldn't really decide what they were supposed to be talking about and deciding, and it violates the Constitution as written. As well as being the worst written piece of shit I've ever read.

That said; there is a "right to privacy in your person... and effects" in the Constitution. There is also the concept that the government cannot impose upon any individual any punishment or obligation higher than obedience to the law without first adjudication on that individual in the courts.

Roe missed those 2 points completely in favor of some wishy washy language for which there isn't a clear majority. Roe is a compromise majority of these 5 for this part, those 5 for that part, and another 5 for a different part, all of which kind of overlap somewhere in the middle but which doesn't encompass all the parts under a majority consensus.

There were and are better ways than Roe.

First of all, the 4th requires that the government keep its nose out of private business unless there's a warrant or sufficient cause as to a particular individual. This even applies to the States via the incorporation doctrine. Abortion certainly falls under the rubric of "private business" and that's all Roe needed to say.

Secondly; if a segment of our society wants to kill their progeny wholesale, let them. As long as it's "legal" they can deny themselves a future generation all they want. If it predominantly hits minorities more than others, it's on them. No one forces any of them to have an abortion, they choose.

What States and Congress can do is regulate the environment where it's done just like they regulate hospitals/doctors for cleanliness and staffing and licensing. Other than that, it's none of the governments business what's being done in those places between a doctor and patient.

Any other position is based on "morals" and not law or the Constitution. No one has the authority to impose God's will on another. You can quibble about that all you want, but the principle is clearly stated and understood.
