Will the Supremes overturn Sotomayor? It happens this morning.

The whole deal was a wash from the git-go.

I have a black son-in-law who's the smartest bunny to ever hop down the Bunny Trail. He has a math degree and is a computer wizard. But his parents are college educated and he wasnt raised to slouch around like Furina or Topsy. So the issue isnt BLACKS CANT DO IT.

The issue is WE'VE CONDITIONED THEM TO THE FREE RIDE. They get a pork chop regardless.

SOTOMAYOR: Why cant Obama nominate a Spic who looks like Mariah Carey? I'd count my lucky stars if Judge Carey sentenced me to hang.

They don't "overturn" a nominated justice. They vote to either accept the nomination or reject it. :confused: It's almost a certainty they will accept her, but it is something of a rude greeting to see one of her decisions overturned like that. Because of the juxtaposition, she may be called on to defend her ruling in the case.

I know. :cool: The fact that the two events are so close together in time is strictly a coincidence. Nevertheless, when she is grilled by the Senate committee, they will probably bring up her ruling. Quotas in hiring, promotion, etc. and this is closely related to that issue, are a major point of contention between Libs and Cons. The former call for a "level playing field" and try to accomplish that by tilting it, and the Cons are in favor of people benefitting through their own abilities, with nobody getting any unfair advantages. They both want to be fair, but they have different ideas of what constitutes fairness. :confused:

Both sides are disingenuous becuz they represent distinct special interests. The GOP (as opposed to real conservatives) have nothing to gain by helping minorities. Blacks and gays and girls will take your gifts and give you the finger as they flee with their loot. Ditto for the Democrats. Give the NRA guns and they'll be sure to shoot your ass if they can.

In this state blacks rarely rise to any level of power, but plenty of them get quick promotions and fat pay raises. How they do it is: Young, attractive blacks are recruited for management positions. In management they are quickly promoted up the chain of command and then sidetracked to a nuthin job with no staff or function, but they get a fat check every week. When everyone has forgotten about the Black Wonder the position is eliminated and youre out the door. Up & Out.

With any intelligence (OK get off the floor) from the Senate, this raises enough doubts about her judgemnt to disqualify her.

She wasnt picked for her smarts. Obama needed a Spic or a wetback with no history of heavy thinking. There are plenty of smart Cubans, but he sure as hell didnt want one, not if we're about to lick Fidel's ass.

I wouldn't go that far, but I believe it should raise doubts. I don't like the idea of activists with agendas on SCOTUS, and I would hope most senators don't either. :cool:

I am all for a level playing field, but you don't get one by claiming it is tilted in one direction, then tilting it the other way. :eek:

It is called 'competition' within a democratic framework, thas the way 'tis supposed to work.

But this Supreme Court decision against affirmative action could be the beginning of the end of the quota system favoring women and minorities over merit.

That would be a good thing.

Affirmative Action is allright, up to the point where it becomes quotas, which frequently happens. After that, it's just discrimination. :eek:

I think the most embarrassing Supreme Court ruling lately was the 8 to 1 decision that strip searching a 13 year-old girl for aspirin was unconstitutional - embarrassing because Clarence Thomas was the lone dissenter. Talk about affirmative action, I seriously don't think he'd be on the court if he wasn't black. I mean, does anyone here think he was picked for the court because of his intellect?

In that light, I think it's rather ludicrous to complain about Sotomayor's appointment.

I agree the strip search was reprehensible at the time. Under other circumstances, such as reliable info that she had hard drugs or a weapon, it might be justified, but only by women.

In actuality, despite what the MSM has 'reported', Judge Thomas is quite intelligent in matters of law and otherwise...unfortunately (for him) he's also fairly Conservative...thus he's been routinely mocked and maligned...including being dragged into the Anita Hill fiasco. He's been a considerable asset to the Court.

Sotomayor is fairly lightweight in her experience concerning matters of law...and her dismissal of the reverse discrimination case and other statements she's made regarding race and life experience as a measure of intelligence and ability vis a vis the law is, to me, disturbing.

I see no barrier to her being appointed to the court...hopefully she'll mature intellectually in matters legal during her tenure...she's replacing a Liberal (Souter) so it's status quo anyway.

And another campaign promise is fulfilled.

for alito, a while back, two of his decisions, all of his decision reviewed, were overturned by the SC. i.e. 100%

IF REVERSAL RATES MATTER.... The conservative Washington Times ran a headline yesterday that read, "Sotomayor reversed 60% by high court." The article quoted a right-wing activist saying, "Her high reversal rate alone should be enough for us to pause and take a good look at her record."
Rachel Maddow had a great segment on this GOP talking point last night, and it's worth keeping in mind as the debate over Sonia Sotomayor's nomination continues, not only because it's likely to be repeated quite a bit, but also because it points to a certain desperation in the judge's detractors.


Sotomayor has been on the appeals court federal bench for over a decade, and during her career, she's written 380 rulings for the 2nd Circuit's majority. Of those 380, five have been considered on appeal to the Supreme Court. And of those five, three have reversed the lower court's decision. That's how the right gets to a 60% reversal rating -- three out of five, as opposed to three out of 380.

Of course, if that 60% figure were really scandalous, the right should have balked at the Alito nomination -- he had two of his rulings considered by the high court, and both were overturned. (That's a 100% rating! He must have been a horrible judge!)

The irony is, Sotomayor's reversal numbers are actually better than the norm, not worse. Media Matters noted yesterday, "[A]ccording to data compiled by SCOTUSblog, Sotomayor's reported 60 percent reversal rate is lower than the overall Supreme Court reversal rate for all lower court decisions from the 2004 term through the present -- both overall and for each individual Supreme Court term."

iirc, McCain, lost Florida in part because he couldn't keep the percentage of Hispanic votes that GWB had, when he carried it. Republicans at times have gained through courting minorities.

All of JBJ's racial innuendo aside, I rather think Sotomayor was picked by Bush the Greater primarily because she was Hispanic. The Bushes were the first of the presidential contenders who understood and went after the Hispanic vote. One of their smarter moves.
 
I've always felt there's a right and a wrong way to do affirmative action. In the case of the promotion practices of the firefighter case, they almost get a third category of "extremely wrong". Making rules then changing them when you don't get the results you want is not only unfair, it's upsetting for everyone. This isn't like public colleges making efforts to try to get their student bodies to more closely match the composition of their state. And unlike tests like the SAT, it's hard to argue that the firefighters didn't all have a fair shot at the test in question. I actually agree with the Supreme Court's ruling, in as far as in this particular case it was unfair.

We don't live in a post-race society yet. The election of Barrack Obama does signify we're a lot closer. Non-whites and non-women being turned away from jobs is becoming rarer. Most companies came to their senses that in the free market, hiring the best qualified candidate made more sense than hiring the fellow with the most waspy name. However, in cases where experience and access to education matter, there is still a legacy of racism. Unfortunately, the answer may simply be to let it all work itself out of the system, which will take decades and possibly generations.

I dont know why Bush41 picked Clarence Thomas. I've worked closely with lotsa judges, and 99% of them dont impress me; I devoutly believe that lawyers who are judges cant hack it as lawyers. Every poor lawyer I know wants to be a judge.

There is no Hispanic race. I know Spics and Wetbacks who are whiter than I am, if its possible to be whiter than me. Two of my kids are 1/2 Cuban and as white as Fidel hisself. When I lived in Spain the average Jose took exception to the world lumping him together with the other Spanish speaking nationalities. He had a name for these others, and it wasnt 'Hispanic.'

I cant imagine any Bush doing anything anyone would construe to be 'smart.'

McCain lost Florida becuz he's an old fool with no ideas but lotsa hubris.

When we speak of affirmative-action what we're really talking about is influence. Your average nigger who's spent his life behind a mule, and decides to be a brain surgeon, doesnt know how to make the switch. He doesnt know any of it. And if he does his homeboyz find him so deviant that he's excommunicated from their society. To their way of thinking scholarship is as troubling as wearing pink hotpants.

So the Guvmint rescues these lost souls. One week Rastus is staring at his mule's ass all day, and the next week he's CEO of Wall Street or got his razor out fixin to work on your brain. LAZ WEEK I CUDINT SPELL NEWROLIGEST AND DIS WEEK I IS ONE.
