They aren't operating within their "discretion," they are derelict in their duty to uphold and prosecute the law, and it's getting people killed.

If a cop pulls you over and decides you are not quite drunk enough to bother with, and then you hit and kill somebody, the cop has committed no crime, and probably is not even exposed to civil liability.
