Legislation is based on fact and in a free society you have to accept some risk. Using your logic then ban cars because someone might lose control and kill someone. Ban alcohol because some asshole will lose control and beat his wife. You don't understand liberty. In a free society, you punish the individual, not ban the behavior. A free society has to accept that there are some risks in the name of liberty.

I've never stated that you should create a society without risk.

The risk is easily mitigated if known precautions are taken by responsible people.
