States cannot keep same-sex couples from marrying and must recognize their unions, the Supreme Court says in a ruling that for months has been the focus of speculation. The decision was 5-4.

Justice Anthony Kennedy, seen as a pivotal swing vote in the case, wrote the majority opinion. All four justices who voted against the ruling wrote their own dissenting opinions: Chief Justice John Roberts and Justices Antonin Scalia, Clarence Thomas and Samuel Alito.

Three weeks...

The ruling will not take effect immediately because the court gives the losing side roughly three weeks to ask for reconsideration. But some state officials and county clerks might decide there is little risk in issuing marriage licenses to same-sex couples.

All four of the court’s most conservative members — Chief Justice John G. Roberts Jr. and Justices Antonin Scalia, Clarence Thomas and Samuel A. Alito Jr. — dissented and each wrote a separate opinion, saying the court had usurped a power that belongs to the people.

Bout time they kicked the Christian Crazy to the curb and started walking the walk with all the "All men are created equal" talk....I only hope the trend continues.

Historic Day

*listens to Maura Healy's speech in Boston*

AG Healey led the filing of the amicus brief pdf format of SCOTUS Marriage Equality Brief on behalf of Massachusetts and 16 other jurisdictions, including California, Connecticut, Delaware, the District of Columbia, Illinois, Iowa, Maine, Maryland, New Hampshire, New Mexico, New York, Oregon, Pennsylvania, Rhode Island, Vermont, and Washington.

In total, 20 states joined briefs in support of the right to marry, including Hawaii, Minnesota, and Virginia, each of which filed a separate brief. These briefs were submitted in the cases of Obergefell v. Hodges, Tanco v. Haslam, DeBoer v. Snyder, and Bourke v. Beshear, all on appeal from the U.S. Court of Appeals for the Sixth Circuit. The cases have been scheduled for oral argument before the Supreme Court on April 28, 2015.

"Today’s decision by the Supreme Court is a huge victory for the equality and dignity of all Americans. The right to marry the person you love is finally the law of the land, and it’s about time. In Massachusetts, we fought for and won this freedom more than 10 years ago. We have seen how marriage equality makes a real difference in the lives of couples and their children, and now the rest of the country will get to see the same. This ruling also ensures that families will not have to worry about losing essential legal protections when they travel or move out-of-state. I am so proud of all of the work that so many put into this effort to make today’s ruling a reality."

What happen this day may well be remembered as the point the USA really started to crumble.

What happen this day was something was made law that was not supported by the constitution or the will of the people.

I no longer know what to say to the people I counseled not to support secession because if all else failed, the SCOTUS would make sure the Constitution was enforced and justice would prevail.

I said it was unlikely we would have to go to extreme measures to keep our religious freedoms and that voting not violence was the way to go.

Well, at least for a while we still have the right to be wrong.

And one of our greatest freedoms was taken away from the people of the United States of America.

I suggest you emigrate, FGB.

First, I think you are absolutely wrong in thinking that the will of the people is against this. I also assert that the Constitution has survived (as will this country) because of its flexibility to grow up with the changing world (perhaps the second amendment, which has been obsoleted and is being incorrectly rewritten now for those who don't understand what a "well-regulated militia" is, could be usefully jettisoned :D).

Third, I delight in seeing the reactionary, uninformed, and ignorant upset by this. I do suggest that they pack their bags and go someplace else--I'd suggest a third world country that hasn't made it even into the twentieth century yet intellectually.

Marriage isn't mentioned at all in the Constitution making that point completely irrelevant. As for the will of the people when it comes to prejudice the will of the people isn't a good barometer. That's in large part what the SCOTUS has been doing.

You're religious freedoms are in no way damaged by this. It's funny hearing people try to pull that crap but you were no less free yesterday than you are today. Other people have been advanced but you haven't been hurt.

What freedom did you lose, try to be specific.

Just for once i would love if someone would explain how this effects them personally or there religion in any way.

Almost as pathetic as the bit on his profile where he says his own religious views are the only possible basis for morality.

Sorry people I'm still trying to find where it says something OTHER than marriage is between a man and a woman in the constitution of The United States.

What about their religious freedom?

Silly , it dosen't mention marriage between a man and a woman either.

Can you find where in the Constitution it mentions marriage to begin with? Even if it did the Constitution wasn't handed down from God, it was written by men. Admittedly very intelligent men but men capable of making mistakes and men who also had to deal with the political realities of the time.

Oh.

That's being chipped away as fast as possible.

Again how, what religious freedom has anybody lost in this country? I mean unless your talking about Muslims not being able to build Mosques because it might offend someone but lets be honest you weren't talking about them.

No that was back in like 08, when Bush and the GOP crashed the fucking country. Which that whole shit storm had some roots reaching back 40+ years in some cases.

And one of our greatest freedoms was taken away from the people of the United States of America.

Which one??

He can't name it because no freedom has been lost...the theocratic bigot is just pissed because GAWD N JEEEEEBUS! are clearly no longer running the country.

I think maybe it's his freedom to tell other people what they can and can't do (which he never had anyway).

It seemed ironic, the disproportionate and inappropriate response to this decision by the regime, juxtaposed with the delivery of a eulogy in a traditional black southern church which customarily supports the true concept of marriage as being between a man and a woman.

OH,

Obama is an ironic Son-of-a-bitch.

He was so happy he broke out in song...

My two cents on this:

The thing that irritates me is the same thing that irritated Justice Roberts. The will of the people was ignored here. Several states firmly had in place voted for amendments to the their constitutions. With this ruling that wipes out any pretense of individual "States Rights'. Which was one of the basic I was taught in school. Each was free to do things the way they saw fit. With this ruling we might as well get rid of all state laws and only have federal. That's what it seems to me.

On the flip side is the fact that since the ruling as tied to the 14th amendment this is ironically a win for gun rights activists. Now a concealed carry permit issued in one state must by virtue of this ruling be accepted in all states whether they like it or not.

The lefts response to the decision is modest and almost muted. I expected more.

I suspect, tho, that the decision will spoil the election for Hillary, because blacks and Muslims aren't Gay friendly, and they know Hillary will appoint judges likely to vote like the Courts libs.

Ginsberg and Scalia are old, and the next President will likely replace them. If Ginsberg goes a conservative may take her seat, and the court will be 5-4 conservative.

Could be a major defeat for Democrats yesterday.

There's nothing "ironic" about your false equivalency born from desperation to find an excuse, however flimsy.

But keep trying to throw out anything "traditionally black" out there on the dart board and see if your wide misses gives you any points. That's what pressed white people do best. :)

Ohhhhhhh look who can't name a single freedom lost despite his bitching otherwise....

Why can't you just admit you're a bigot and it pisses you off gays are treated like human beings now?
