“Well, the Constitution is clear, and that, of course, is the supreme law of the land—that the privilege of the writ of habeas corpus can be suspended in a time of invasion,” Miller, the architect of Trump’s child and family separation policy during his first term, told reporters on Friday.
note that wording in bold... privilege as opposed to understood basic right and tenet.


“So I would say that’s an option we’re actively looking at,” Miller declared, before attacking the judicial branch.

“Look, a lot of it depends on whether the courts do the right thing or not.”
and this ^^ Shades of pence and a not indirect threat to judges who would rule against trump. Not doing 'the right thing' places those same judges/juries/witnesses in the crosshairs of the rabid. Miller is perfectly well aware of this; he chose his words accordingly.


Habeas corpus is a cornerstone of Western democracies, with roots tracing back to the Magna Carta of 1215, which first established the principle that no person could be imprisoned arbitrarily by the king.

Miller, who has no law degree and is not an attorney, went on to give reporters his understanding of constitutional law.
“So,” Miller concluded, “it’s not just the courts aren’t just at war with the executive branch, the courts are at war with these radical judges, with the legislative branch as well, too,” he opined.
Now it seems to me that this is exactly the kind of wording to create greater unity amongst judges rather than divide them. The courts, especially the Supreme Court, will not take kindly to such overt displays of threats to the co-equal legislative third of the gov't.

They will push, and push, and keep advancing their trump-agenda until those they are pushing push back. We've already seen examples of this with trump's persecution of law firms he's targeting.

You may want to look a little closer at WHEN it was suspended and WHY.

We aren't at war.
We aren't being invaded.

The emergency is a farce and Congress should end it.

And THAT ^ is what decent, intelligent individuals (non-MAGAts) WERE warning about and ARE fighting against.

It is NOT about “Kilmar Abrego Garcia” per se, as DonOld & the MAGAts would like to pretend (gaslight). It really IS about whether due process, the rule of law, the constitution, and the coequal branches of government’s checks & balances (basically, the American “idea”) will continue to exist moving forward.

It is only 11 million, most of them have been here a lot longer than five years, and we would in no way be better off without them.

Most of them entered the country legally and overstayed their visas -- it is not a border-control problem.

Meh. Miller said they’re actively looking into it. Also said he thinks it’s constitutional, and that it depends on the courts. He’s right. Left wing Alternet obviously has its opinion but they don’t get to adjudicate legal disputes. It’s up to the courts, possibly the Supreme Court

It was only a matter of time before they started looking in to the possibility. As Lincoln famously uttered when he suspended Habeas Corpus, "The Constitution is not a suicide pact."

And still, no one is blocking the President from deporting migrants.
