Sorry, but you don't get to make up the law. 18 USC 3 specifically defines an accessory after the fact as someone who, in addition to his knowledge of the commission of a crime, "receives, relieves, comforts or assists the offender in order to hinder or prevent his apprehension, trial or punishment.." It takes overt aid or assistance to rise to the level of an accessory, either before OR after the fact.

Interestingly enough, however, Section 4 of that same title 18 DOES require the reporting of the commission of crimes by anyone having such knowledge, but that applies only to crimes AFTER they have been committed.
