Federal judge tosses Bronx gun case over racial makeup of grand jury

Judge AnalisaTorres dropped a gun case in the Bronx over the racial makeup of the grand jury.

A Manhattan federal judge dismissed a case against a reputed gang member in a shooting last year — because the suburban grand jury that indicted him wasn’t diverse enough.

That's progress, but thankfully, we have judges who don't see race when interpreting the law

But instead of asking Torres to reconsider her ruling, the prosecutors revealed that Scott had already been re-indicted by a different grand jury and his new case was assigned to a different judge.

Progressive Reform = White people are too racist to sit on the jury of a minority, therefore, no trial, case dismissed, run along and continue committing crimes at your leisure.

Rule of Law: Innocent until proven guilty through due process. Justice for the victim, or vindication for the accused, but a trial will take place, evidence will be seen, and testimony will be heard. Everyone gets their day in court.

Democrats: Do you feel that minority defendants should have their cases dismissed if the majority of jurors indicting them are white?

Before you answer, here are the Defendants Stats
Scott, 43, is charged with being a felon in possession of ammunition tied to the seizure of three, .380 Eldorado-brand shell casings following a caught-on-camera shooting in which the victim was shot twice in the leg.

Scott is a reputed member of the Bloods gang who allegedly opened fire outside 765 E. 183rd St. amid a dispute with the 36-year-old victim, who lives on the block, law-enforcement sources said.

So, Democrats, was Judge Analisa Torres justified in dropping the case before the case was reassigned to a non-racist Judge?

"Jury of your peers" - seems to suggest something....not sure if you may use that in your analysis

Ill have to review my notes, but I don't remember any additional qualifiers on that.

Whether there’s a mistrial or not is a matter for the judge and lawyers involved to decide.

No. But that's not what happened here. If that had been the case, your link would undoubtedly have said as much. Instead it avoided any mention whatsoever of the racial makeup of the jury - a pretty clear indication that it wasn't simply a matter of "a majority of jurors" being white, more likely they were all white. And that's a practice that was abolished for a reason.

She's a federal judge with twenty years on the bench. She knows the law better than you do, score_keeper.
