RIP you will be missed

Now you try to get all commonsensical on my ass. There was no advice on where to take my dick to pee if I'm feeling womanly.

Does common sense involve not basing suppositions on lies and half truths?

Does common sense involve not basing suppositions on lies and half truths?

Common sense is basically doing what makes sense and not making others accountable for your lack of it.

The hot coffee thing is a perfect example, that and the "do not eat this" that is put on those packs of silicon in packaging.

Common sense actually has nothing to do with racism or sexism -unless you want to say people should no better than to judge by anything other than the person themselves-so it shouldn't be attacked here in PC land.

But I'm sure it will because the end part of "I'm a victim" is what drives a good part of the bullshit of today's society.

Do you actually know the facts of the McDonald's coffee case?

Its something to talk about no one has to believe it, but wow does it ring the bell.

Guess the point is right, no one wants to be thought they have to be accountable for anything.

Stop parroting your wife, its boring.

And it doesn't matter if I do or don't, I posted the link without editing another person's writing, take it up with them.

But here you go with the lynch mob everyone is a victim, again it proves the basic point of the Wah wah world.

So you aren't taking responsibility for what you post. Got it.

oh for fucks sake

what a load of crap

esp the mcdonalds case, you would think someone would actually look up what happened instead of going by what the corporation wanted out

Did this article strike you as may be biased? The internet is filled with stories that have an agenda regardless of facts. The op storied was biased but did not present itself as news or fact. What you posted IMO presented itself as fact.

Yes, we do:

https://en.wikipedia.org/wiki/Liebeck_v._McDonald%27s_Restaurants

The relevant portion:

Liebeck was in the passenger's seat of a 1989 Ford Probe owned by her grandson Chris, which did not have cup holders, and Chris parked the car so that Liebeck could add cream and sugar to her coffee. Liebeck placed the coffee cup between her knees and pulled the far side of the lid toward her to remove it. In the process, she spilled the entire cup of coffee on her lap. Liebeck was wearing cotton sweatpants; they absorbed the coffee and held it against her skin, scalding her thighs, buttocks, and groin.

And a bit more:

http://mentalfloss.com/article/26862/real-details-hot-coffee-lawsuit

The only real issue is the woman (or her attorneys) wanted McDonald's to pay for the medical bills which McDonald's refused. That is why it went to trial. In the end, as the above links show, the award was continually reduced until an out of court settlement was reached.

That said, the article posted about the death of common sense is spot on. If you don't know that coffee is hot and that putting it between your legs while opening the lid is asking for an accident to happen, then truly common sense is dead.

Denny

Sadly common sense is not as common as it once was.
It seems like my grandma told me coffee was hot when I was around two or even younger. I didn't doubt her since I could see the steam rising from the cups.

No, the relevant part is here:

Further, McDonalds' quality assurance manager testified that the company actively enforces a requirement that coffee be held in the pot at 185 degrees, plus or minus five degrees. He also testified that a burn hazard exists with any food substance served at 140 degrees or above, and that McDonalds coffee, at the temperature at which it was poured into styrofoam cups, was not fit for consumption because it would burn the mouth and throat. The quality assurance manager admitted that burns would occur, but testified that McDonalds had no intention of reducing the "holding temperature" of its coffee.

All the articles that came out was about making this woman a laughingstock. The fact that there are still people who think this is the issue.

The powers that be took this case and ran with it to prove that we should not have the right to sue due to "frivolous" reasons.

Go back and look, it was all about how stupid this woman was and how the poor small McDonalds company should not have to actually follow the rules.

Denny

McDonalds coffee, at the temperature at which it was poured into styrofoam cups, was not fit for consumption because it would burn the mouth and throat.

I can't drink any fast food coffee until it cools down quite a bit. This I have learned by using common sense.

They heat it to a higher temperature so customers don't bitch that it's too cold by the time they drink it. Eating a crappy Big Mac or Chicken McFuggits usually comes first.

Even worse, it presented itself as sensible.

If it's not fit for consumption because it's so hot why would you put it between your legs and open the top? Wouldn't common sense be to wait for it to cool down?

More to the point... Why would they sell it?

Carbolic Smoke Ball Company.

Google it.

It's the grandfather of product liability cases.

I've found, those who bluster about having the most common sense turn out to be the biggest dipshits...

But that's just my observations...

It's just a way for Baby Boomers to pat themselves on the back for being so much wiser than their "idiot" grandchildren. They pass this kind of shit back and forth in emails to each other all the time.

They'll bitch about the McDonald's lawsuit, but won't bat an eye when a judge sends a man to prison for the rest of his life for $20 worth of pot.

If McDonald's hadn't been so cunty about the whole situation, it could have been resolved quickly and cheaply. But let's blame the victim again.

Why? Because of not doing stupid things then blaming someone else? Not destroying property claiming they were trying to have fun? Not endangering others and laughing about it? Not whining about how they were injured because they couldn't be bothered to follow the warning signs?

You know why there are warning signs on hair dryers not to use them while in the shower? Because someone didn't think common sense applied to them.

Because people like their coffee hot and most everyone else on the planet understands it is hot so doesn't put the cup between their legs.

At her age she should have known better.

Let's use a hypothetical. Suppose they drove a short distance to a local park where they took their McD's and sat at a table to have a nice talk. While opening the lid of the coffee to put in her cream she still spilled the coffee on herself and still got burns.

Would you still say McDonald's is at fault?

Not really. I think it would be safe to say that 99% of us has spilled something very hot on ourselves. I'd say 99% of us have grabbed the handle of a pot we knew was hot and burn the fuck out of our hands.. The only difference in the McDonald's case is NOT common sense. It was a mistake.. A dumb one which we all have made... The only thing that sets this as new is that the person decided to sue. That's just a plain old case of legal system abuse. Where McDonald's fucked up? When they knew it was unsafe to drink at the temperature they were requiring it to be served. The lady was greedy and made a mistake... That's says more about the shift in our get something for nothing current culture.

I would of been way to embarrassed... Plus my dick would have scalding liquid on it... Not a good morning.

Every warning sign/label you see is because someone did something stupid and then sued because they weren't warned about it. Look at any instructions for things you own. Do not put your hand in the blender with the rotating sharp blades.
