When you insert the word rape into something, it really turns it into a hot-button emotional issue, doesn't it? The fact is, it would be cost-effective for any company to continue doing business with the federal government were that to pass. I have to side with the Republicans on this one - as kbate pointed out, this is an extreme over reach. You just can't force a company into arbitration over any and all personnel issues by withholding payment. The "Republicans for Rape" aspect is a strong-arm tactic.

The amendment is a giant power grab for the government - forcing every company which wishes to do business with the government - to open itself to a barrage of "negligent hiring" lawsuits, "Improper promotion" lawsuits" and other lawsuits based on "failure to fill quotas based on colour/sex/race/whatever".

It's a lawyer's dream, going far beyond the intended purpose of removing company policy such as those that KBR abused.

Had it simply listed the felonious articles, "sexual assault, assault and battery, and sexual harrassment" - the vote would have been different.

While you may find the final three provisions unwarranted, all were based on the findings of the 5th circuit court, which found that none of these incidents should be addressed through arbitration.

The 5th circuit court found that even when you sign an employment contract requiring arbitration that there are some rights to sue your employer that just can't be signed away. These include assault and battery, infliction of emotional distress, false imprisonment, and negligent hiring, retention, and supervision.

Franken's amendment extends much of the 5th circuit's reasoning to government contractors who continually subject workers to mandatory arbitration clauses. In my opinion the amendment did not go far enough, it should not have singled out only government contractors, but ALL companies.

Trying to argue that corporations will be somehow unduly burdened with costly frivolous lawsuits is a non-starter. Corporations routinely engage in long drawn out legal battles that they know that they can't win to force a plaintiff to relent because it's too financially costly for them to pursue. This tactic is most often used when the legal expense to the company (who usually have lawyers on retainer and so face minimal additional costs to fight a suit) is smaller than the cost of settling or losing the case. Tobacco and Insurance companies, for example, are famous for this. I have zero sympathy until or unless evidence can be produced that a company was penalized when they actually did nothing wrong.

I was looking down the list hoping no one from my state would be on it. I wish he wasn't but right near the bottom was David "whorehouse" Vitter. I hope he loses the next election. I don't care if its to another republican. He is a horrible man and claims to be a "family values" candidate.

Yes, I do know where I am, at least I think that I do... I do know that I am in all likelihood in the minority as far as political opinion goes... But alas, I prefer it that way because I really do not care for having such discussions with people that I agree with most of the time.

That said, I happen to know a bit about the discussion at hand. There is more to the story than what the press, or even Al Franken has attempted to do in his grandstanding stunt. Things are dubious at best... I would think that the truth of the situation is more important that the leanings of the forum on which it is being discussed, no?

This isn't a new story TLG. It has been around a while, and I've been around the military contracting world a while. If the juice was there to bury the accused, I can assure you that they'd have done it; and they would damn sure deserve it if they did it. But as it is, the details are "murky"... Kind of like that Lacrosse team that got wrongly accused.
