i represent those guys.

they don't have cable. hell, here in the mississippi delta, they don't even have air conditioning. unless you are posting from gitmo, i assure you, you have more rights and liberties than they do.

and the cards are stacked against them in the appeals process because of procedural bars, time limits, and presumptions in favor of the verdict. once a conviction is affirmed on direct appeal, trying to overturn it in habeas now is akin to a fool's errand.

most murderers never make it to death row. even really bad scary ones. what about the possibility of those guys getting out on parole?

Those scare the shit out of me too. Alas, I have run out of arguement. I do not concede, but I fear I will only repeat myself. Thank you for the mind work out...I do appreciate it.

But can you cite an actual incident? Do you know of a relatively recent innocent put to death?

This is a hard question to answer because most of the time the work to prove actual innocense stops with the execution.

However, the case of Paul G. House in Tennesse has a good chance of going all the way. House was convicted of the rape and murder of a neighbor woman. He was convicted on semen and blood evidence plus eye witness testimony that he was seen leaving the wooded area where the body was found.

The appeal was heard by the 6th circuit sitting en banc. The decision to affirm was by a vote of 8 to 7. The semen that was used to convict was found, after the conviction but before the appeal to belong to the woman's husband. The husband had the reputation of abusing his wife. The State medical examiner testified that there was reason to belive that the blood evidence had been planted. And, an examination of the relitive positions of House and the witness that saw him leaving the area where the body was found were such that the witness could not have seen what he testified to.

Also produce was testimony that that the husband had both threatend to kill his wife and that he had confessed to the murder. The majority discounted the credibility of this evidence because it offered ten years after the trial. The witness offering the testimony was around eighteen years of age at the time of the murder.

Considering that one of the Supreme Court Justices is of the opinnion that actual innocense is no bar to exicution, if the defendant has recieved due process, this one could go all the way.

Anybody who bitches about prisoners having cable TV and air-conditioning has never spent one day in prison. I guarantee it. They are the same fucks who honk their fucking horns when they're stuck in traffic for five minutes. Even a suite at the Ritz would suck if you could NEVER FUCKING LEAVE!

They don't give a shit about innocents in prison because they think they're just a bunch of fucking niggers anyway. Probably guilty of something anyway. Or would be soon, anyway.

Fuck all you cracker motherfuckers. If it was your little brother in the can, you'd be the first one screamin for a lawyer. Fuckin hypocrites.

Easy bubba...
Ya, it sucks when innocent people go to prison, and I wish there was more that we could do about it. However, I don't have the money to hire lawyers for them, and I'm not one...sorry.
The Ritz may suck if you never get to leave, but you shouldn't have committed a crime to get stuck there in the first place, so that arguement doesn't really fit, does it?

The argument does fit since we started out talking about innocent people.
