Recuperating from breast augmentatation saves woman from breathalyzer woes
News-Journal wire services
VANCOUVER, British Columbia -- Donna Pringle has a novel defense to explain why she was unable to take a breathalyzer test: She blames her new breast implants.
A police breathalyzer technician testified at Pringle's trial that the woman refused to comply with his instructions on the proper way to blow into a breathalyzer machine.
The woman simply pretended to blow during the test, he told the provincial court judge.
But Pringle testified that she was unable to blow harder because of breast augmentation surgery.
Justice Kathryn Neilson overturned Pringle's provincial court conviction on Monday, saying prosecutors failed to prove that Pringle deliberately tried to fake her breathalyzer test.
The officer picked Pringle up around midnight Sept. 22, 2000, while she was sitting behind the wheel of a pickup truck in a hotel parking lot. He testified he smelled liquor coming from her breath.
