As many of you know, I'm about to embark upon a Medical Negligence legal action. One thing unknown about me by my solicitor is my writing 'career'. I'm proud of my writing skill, 630,000 views averaging 90% voting approval + 3 novels in draft. But I haven't been able to really concentrate on completing anything since the illness became severe mid-2006.

There is an advantage in mentioning this to my solicitor as I'm deprived as a result of illness in partaking in an activity I enjoy... but there is an obvious risk. 'Proving' my writing credentials leaves me exposed as a porn/erotic writer, which could be viewed, quite unreasonably in my opinion, as prejudicial to any financial settlement depending upon the judge's moral standpoint.

I've more or less decided not to mention my writing. I wonder what view fellow authors might take?

Even a hint of impropriety gives your former doctor's lawyer an opportunity to weaken your case.

Are your works in progress erotic? You could mention those then.

I'm thinking it would be a good idea to bring it up with your lawyer, so they can prepare in case your writing is discovered.

No... the novels are pretty much what you might find in any book store as far as erotic content.

It might be a good idea to mention the writing, as you say, and I wouldn't really be overly concerned if the opposition discovered me here as I've often posted that my Lit writing was used as a device to develop different 'voices' for mainstream writing. Guess the other thing I could do is have Lauren take down my Lit stories. That might be a good option, all things considered; though it would be a reluctant choice.

I wouldn't mention Lit, no. I WOULD mention your writing and how the illness has interrupted that. They don't need to know what you write - just that you DO write, and have been unable since you got sick.

I've just fired off an email to the solicitor asking for her advice. I've got to sign the final evidence statement in next 48 hours.

I'd agree with you, James, but that's a bit like saying 'unless you earn income from fucking, who you fuck is irrelevant'. Writing, like fucking, brings enjoyment. Enjoyment has value, denying enjoyment through negligence has value.

Very seconded. It may be something which you want to leave out of your case, but your lawyer needs to know in case the opposition decides to bring it up. If nothing else, swiftly swatting the opposing lawyer's sleaze attempt with a note that this is another activity which is denied the plaintiff will give you the whip hand.

Yes, BUT - unless you're female you probably DON'T earn money from fucking.
