wanted to know if it's allowed to use a painting as an AV, it being someone else's work and probably copyrighted? i think i found out enough to know how to post an AV, just haven't found one to put up.

As far as I remember, AVs are outside of the copywrited thingie. You can use whatever image you like, though some do give credit for their AVs in their sig lines.

Avatars are NOT exempt from copyright laws, although they're seldom targeted for enforcement. I have heard of people being asked to remove a copyrighted avatar, though.

Several people have gotten permission from artists to use their work as Avatars, it not usually difficult to get permission to use what is essentially a thumbnail version of a painting if images are already online.

If there is any doubt about whether the artist might object, then ask them. (If the artist is dead theyprobably won't object, but their Estate Manager might.)

Some big corporations are more likely to object if they own the copyright to the painting -- Disney has demonstrated the required degree of pettiness to object to one of their images as an avatar here.

Copyright laws can be so screwy.

I've always wondered in this day & age how far they can extend them. I've always wondered if someone "borrowed" a copywritten photograph and altered it in such a way it barely resembles the original- is it still infringing on a copyright?

Prime example for me would be Andy Warhol's use of the Campbell's Soup label. Could Warhol technically be in violation of copyright law??:confused:
