Because I like Heller I overlooked what I think of is a problem with Heller in a lot of other decisions in that I don't believe the incorporation Doctrine was intended to incorporate the Second Amendment. Specifically because historically various States had various policies about having their own 2nd Amendment on the books or not.

Part of what he's arguing though about the reason for the Second Amendment seems to call into question Lincoln's war of Northern aggression. Clearly he understands that the states were designed to be Sovereign and that the second amendment was to ensure that that was possible.

Also of course I'm interested in what you think of what he actually was trying to say here as well.

I've followed the stories, this isn't the first regarding D.C. homeowners protecting their 2nd Amendment rights.


Why should D.C. residents be denied the same rights that the rest of America has?

To answer your query, Justice Stevens doesn't think that the rest of the country has the right to defend themselves either.

He seems to think that the shall not be infringed part means that you can infringe as much as you like up to and including making private ownership of firearms essentially an impossibility.

I don't have an ounce of respect for Steven's opinion on the Second Amendment and neither should any other American who can read plain English. Heller is the most extensive study of the Second Amendment ever penned in American jurisprudence. It only affirmed what the majority of Americans already believed to be true.

Americans have never been ignorant of what the Second means and they've never thought for a minute they'd have to wait 200 plus years to have it explained to them either.

Getting off point just a bit, I do wonder what would happen if the enslaved people of North Korea were heavily armed? It makes me wonder if certain power hungry elements in various governments around the world are really interested in "gun control" - or "people control." You make Heller sound like it wasn't a bi-partisan squeak by.. the ruling was 5-4 right down party lines. It could barely even get the majority of the court to rule in it's favor.
