The Supreme Court ruled in Brown v Board of Education that Separate, but Equal was unconstitutional.
They ruled in Loving v Virginia that marriage is a "basic civil right".

While I'd like to agree with you that government shouldn't be involved, the fact is that it is involved. The struggle for gay marriage is focused on getting those 1,138 rights that we don't have. If my partner is in the hospital and is very sick and only family can visit her...I can't go. What we think about ourselves doesn't matter, it's what the government thinks that matters. (Keep in mind that licenses issued to gay couples in Massachusetts don't apply anywhere else in the nation. If you are on vacation together and one of you is in an accident, the family can fly out and visit, but you still can't until the partner is stabilized enough to go back to Massachusetts.)
