I filed for child support after all these years today. I always felt bad about him being on VA pension, and not only that, he's a really scary man who gives nasty pay backs.

But seriously, what are the chances of me getting child support when he's on VA pension?

Extremely good. Federal agencies are probbaly the easiest places to have child support orders enforced. Have your lawyer send the VA a copy of the court order and they'll start deducting it from his monthly check and sending it to you within weeks.

I don't know about the VA sending me a check. When we were married, his check was much larger because of the children, and when we separated, he paid me voluntarily. It was a good amount, but since we divorced 7 or so years ago, his check went down by 1000.00, and I haven't received nothing but 40.00 and cracker jacks.

And yup, he likes to give paybacks.

His options were to either give you CS money or take the kids more often. And if this is an old case with a lot of back pay involved he should have been taking care of it before it became an issue.

I don't have a lawyer, but I suppose it wouldn't be a bad idea.

The thing is, he has another daughter who was being raised by his sister. She's off and married now, but when she went for child support, he had to send the check directly. The VA never got involved.

I pay an ex for a child, if I was to have visits every weekend and dinner on Wednesdays I'd be paying zero. Likewise while we were in court there was a guy who moved out of state, had no visitation, and owed like $2000 a month for 2 kids. It's based on income levels and time given.

When I filed years ago, they said it might be difficult because he makes such a small amount. I later canceled the case...like I said...for many reasons.

Think about it: he's a crazy man who's a pill junky and only makes 890.00 a month. And I can't prove this now, but as of 4 mos ago, he had 3 doctors and was selling pills on the street. I have mixed emotions about it. Like, if I get any money at all, it'll probably be dirty money. That makes me sick. I know my kids deserve it, but still.

I've never heard of such a thing. We have my step son all the time, it doesn't reduce any child support. Now, when he comes in the summer for long periods of time, 6 weeks or more, we can have the support reversed. She would have to pay hubby support for that time. We have never done that, though. It's not worth the hassle and she doesn't have any money anyway.

Oh, and good for you, Loveu. You will get support, it may not be much, but he will have to give up some of that pension. As others have mentioned, they will take it right from the check before he ever sees it.

Yeah. There are multiple rates. "Single", "Married", "Married with minor dependents", and "Single with minor dependents".

If your divorce decree didn't specify any responsibility for him to pay child support then he probably went from "Married with Children" to "Single". Once the support order is in place he should move to the "Single with minor dependents" rate.

I have no way of calculating how much that is because it depends on a lot of factors like his disability level and if ther eis any other income source. VA pensions aren't easy to figure out like straight military pension amounts.
