In California the governor and attorney general nullified a state law making same sex marriage illegal when they refused to defend the law in the federal appeals court. Its a clever trick; if a majority support a law find an opponent to challenge the law then refuse to defend the law. The opponents win by default. Or so the hope is.
Another new political twist is, prosecute conduct thats legal. That is, if you oppose law the courts approve, toss people into jail anyway and force them to trial.
