Baltimore police officer files motion claiming Freddie Gray knife was illegal

"A Baltimore police officer charged over the death of Freddie Gray has attempted to compel the Baltimore state’s attorney Marilyn Mosby to produce the knife Gray was arrested for carrying, contending that it was an illegal weapon and as such Gray’s arrest was justified.

Mosby charged six officers last week over the 25-year-old’s death in custody, finding not only that officers were negligent in their treatment of Gray, but that he was also illegally arrested as the knife found in his possession was not a banned “switchblade” and therefore legal under Maryland state law.

A motion filed on Monday in the Maryland district court by lawyers acting for officer Edward Nero, one of the three involved in arresting Gray, contends that Nero found the knife clipped to the inside of Gray’s pants pocket “with the blade folded into the handle”.

The motion argues that a “careful inspection of the knife” would reveal its illegality.

According to a Baltimore city police ordinance, any knife with an automatic spring or other device for opening the blade is illegal.

But Mosby swiftly issued a statement on Tuesday afternoon, signalling she has no intention of releasing any evidence before trial.

“While the evidence we have obtained through our independent investigation does substantiate the elements of the charges filed, I refuse to litigate this case through the media,” Mosby said in a statement.

“The evidence we have collected cannot ethically be disclosed, relayed or released to the public before trial,” she added."

"A witness to a police officer's fatal shooting of Michael Brown last summer in Ferguson, Missouri, has filed a lawsuit alleging that he was wrongly stopped and fired on during the encounter on a city street.

The lawsuit, filed last week by Dorian Johnson, claims that the officer, Darren Wilson, fired at him and Brown as they ran away from him on Aug. 9. The lawsuit claims Wilson targeted him without probable cause.

"Officer Wilson acted with either deliberate indifference and/or reckless disregard toward" Johnson, the lawsuit says.

The suit also cited many of the Departmet of Justice findings, arguing that the city and former Police Chief Thomas Jackson "facilitated, encouraged and/or instigated" biased police behavior, including the "excessive force" used against Brown and Johnson.

The lawsuit seeks $25,000 in damages.

A Ferguson spokesman said the city would not comment on pending litigation.

Johnson's St. Louis lawyer, Daniel Brown, did not immediately respond to a request for comment.

Brown was fatally wounded by Wilson in the confrontation, while Johnson escaped uninjured, and became a primary witness. Riots and looting followed the killing, and reignited after a grand jury declined to charge Wilson with a crime.

A federal investigation later found no evidence that Wilson acted illegally. But the U.S. Department of Justice issued a scathing report that outlined a pattern of racist and biased behavior that violated black citizens' civil rights. That report forced the firing of several municipal employees, and the city promised a series of reforms.

Brown's parents are also pursuing a wrongful-death lawsuit against the city of Ferguson, Wilson and Jackson."

"Tiffany Mitchell, another eyewitness to the Michael Brown shooting in Ferguson last weekend, spoke out on CNN tonight. She told Don Lemon she saw Brown trying to pull away from the officer moments before he was shot. This comes days after a friend of Brown’s who witnessed the shooting said the police officer is “guilty of murder.”

Mitchell said Brown had started running from the police officer, and the officer ran after him, firing his gun. Then, she said, “the kid’s body jerked as if he was hit from behind and he turned around and he puts his hands up like this and the cop continued to fire, and he just dropped down to the ground.”

She described the officer in question as a tall, white male, and told Lemon she heard at least five or six shots.

And in addition, another person connected to Mitchell, who she was picking up in the neighborhood, was also witness to the shooting, and Mitchell’s lawyer said her account provides the same information about what happened that day."

This is an excellent witness, in my opinion. Extremely credible. The police officer involved in this shooting is entitled to being considered innocent until proven guilty under our law, but I now believe he's in very deep trouble. This witness alone should be enough to send him to prison for a very long time, in my opinion. She's the kind of witness a prosecutor will love.

"(CNN)Police have arrested Dorian Johnson, the man who was walking with Michael Brown when he was fatally shot by an officer in Ferguson, Missouri.

Officers arrested Johnson Wednesday after he allegedly interfered with an arrest and was seen "discarding suspected narcotics on the ground," St. Louis County Police spokeswoman Leah K. Freeman said.

Charges in the case have not yet been filed, Freeman said. Johnson's attorney did not immediately respond to a request for comment.

The arrest came on the same day that an attorney announced Johnson is suing the city of Ferguson, its former police chief and former officer Darren Wilson. In the lawsuit, Johnson claims he suffered psychological scars and emotional distress on the day that Wilson stopped him and Brown, CNN affiliates KTVI and KPLR reported. He is seeking at least $25,000 in damages and is also asking for an injunction to stop what he calls discriminatory police practices in Ferguson, KTVI and KPLR said.

The August shooting of Brown, who was black, by Wilson, who is white, sparked protests in the St. Louis suburb and across the United States, fueling a national debate over whether police use excessive force, particularly when it comes to dealing with African Americans.

In November, a grand jury decided not to indict Wilson."
