While the Supreme Court has said former presidents have some authority to assert executive privilege, some legal scholars say such an assertion would stand little chance of shielding information sought in a criminal investigation.

Jonathan David Shaub, a law professor at the University of Kentucky and a former attorney with the Justice Department’s Office of Legal Counsel, said he believes any assertions of privilege from Trump or Cipollone before the grand jury would be “frivolous” and federal prosecutors would be able to move quickly to force compliance.
The Department of Justice (DOJ) “has a much more effective and quick enforcement mechanism to go to the district court and have these claims of privilege adjudicated and almost for sure rejected,” Shaub said.

“My guess is given how tenuous his claims of privilege are that we’re not going to hear much else, that he’s going to enter into negotiation and ultimately get the best he can from DOJ and then comply, because he doesn’t have much of a leg to stand on,” he added.

I've already seen people saying it isn't possible for him to have classified information since he could simply de-classify it at will.

Whether a document has been declassified or not is readily available. First, there's a paper trail existent on that being done. It isn't done by a president flicking a magic wand. And, second, it's marked right there on the document itself. The answer of whether the seized documents have been declassified or not is readily available. The fact here is that they weren't, that Trump and his minions are lying, and that, legally, unless Trump is held above the law, his ass is screwed.

what we're likely to see in the next few weeks:

  • near silence from the DOJ as meticulous investigations take place
  • documents are assessed by agencies involved as to how much damage has already been done
  • a lot of clatter from the trumpsters demanding to see the affidavit...which doesn't get released until an indictment happens so all hot air
  • a lot of speculation from both sides...the laws of attraction, a vacuum needs filling
  • a lot of dissatisfaction with Merrick G and the DOJ for not immediately arresting trump
  • a lot of trumpies claiming 'victory' over 'empty, politically-driven "raid"'
 
And what we should see is some Republicans finally reading the screaming red writing on the wall and doing a U-turn to start trying not to look like idiots.

McConnel, for instance, who clearly has wanted Trump six feet under for years. He could survive the total reworking of dumping Trump and looking for others who are half-way viable. This is one of those watershed moments when any Republican could say that this was a crime too far for them.

I am sure that others will note the irony that McConnel's very obvious political ambition to get rid of Trump depends entirely on the actions of a man McConnel disgracefully blocked from consideration for the Supreme Court. If Garland finishes Trump though, I somehow doubt that he will get a thank you note from McConnel.

McConnel is the only rival to Trump for his destruction of US institutional norms.
