Mentally Challenged and voting

Does anyone know if people suffering from retardation can vote? If they can make it to a polling station or obtain an absentee ballot who is to stop them?

How about those placed in some sort of mental health facility? Are their voting rights intact?

I know that voting is brought into, by machine or paper ballot, retirement AND nursing homes. Believe me, some of those dementia patients haven't a clue but can vote. Is that good?

Is any of this covered under the Federal Voting Rights Act?
 
I believe it's on a state by state basis. For example here in Michigan, our Mental Health Code prohibits denying any individual the right to vote or an education.

Not sure how I feel about it, honestly.

In most states, any person who has been declared (by a court of law) incompetent to make his/her own decisions is unable to vote. Basically any adult who has a legal guardian.

Interesting. I know of several mentally challenged people who have their affairs managed by designated "Power of Attorney." In fact, I would suggest that is the arrangement for most rather than full legal guardianship. In cases of dementia decision capability is seldom brough before a court.
So, presumably a lot of clueless people can vote. I would guess that many don't though.

I recall when my Grandmother was alive, she had no idea about the issues or truthfully the candidates but she always voted absentee and a straight ticket.

I personally dont believe in this but that's what occured.

This is interesting too Miss Ali. How can any state define rules for a Federal election? I don't understand how state jurisdiction exceeds the Federal Voting Rights Act. The whole purpose of it was to eliminate poll taxes and all those crazy things states like Mississippi did to keep blacks from voting.

Yes I know of two homes that have mentally challenged and elderly living in them. Some obama recruiters today have been coming in and getting votes from them.

a person with downs may well hold down a job and pay taxes. if he has to live by the laws of the land then shouldn't he have an input?
