A three-judge panel of the 9th U.S. Circuit Court of Appeals unanimously ruled that the Justice Department's policy interferes with the free-speech rights of doctors and patients.

"An integral component of the practice of medicine is the communication between doctor and a patient. Physicians must be able to speak frankly and openly to patients," Chief Circuit Judge Mary Schroeder said.

The 9th Circuit upheld a 2-year-old court order prohibiting the government from stripping doctors of their licenses to dispense medication.

The dispute is one of several cases resulting from medical marijuana laws on the books in eight states.
 
Yep. Good decision. Nothing is more intrusive than the government in the exam room with me and my doctor, except for maybe the government in my bedroom with me and my whip toting partner.
 
woohoo! go 9th circut.

the decision will be overturned right quick, but at least they try :)

For $150 and a physician statement you can become a registered patient and grow your own marijuana in Oregon.

If I grew it, I don't think I would want to smoke it.

Or I would have to set up a big hydroponic system and spend all my time growing it.

(3) A patient and a designated primary caregiver may not individually or collectively possess more than a total of three mature marijuana plants, four immature marijuana plants, and one ounce of usable marijuana per each mature plant, if present at a location at which marijuana is produced, including any residence associated with that location.

What a farce. It's been proven time and again that pot relieves pain and also nausea brought upon by chemotherapy. I have a friend who had half his pancreas removed and has been essentially throwing up nonstop ever since - and the only thing that works to relieve that nausea is marijuana. But god forbid, they should make it legal and reduce the amount of money these drug cops and prosecutors receive every year for fighting this horrendous crime. Go after the dangerous stuff - let these poor people have at least some measure of relief.

I remeber my grandfather getting his medical joints. It was rare he smoked them, and did so on our request. (no we didn't join in) it did help him quite a bit.
 
The point is

government intrusion, plain and simple. It is not about marijuana use for medicinal purposes.

I believe the Govt's intention was "no tolerance". How can they wage a war on drugs when some forms are allowed?


I believe in medicinal use of pot.

I believe anything outside of a prescription should be handled by appropriate laws of that state.

What it's about is the government stepping in and making decisions about what people should or should not own, can or cannot do, and in general legislating responsibility.

God, the irony.

I agree - the government has no place being involved in doctor/patient conversations, discussions or actions. Can you imagine what kinds of problems this kind of action could bring? Who would feel comfortable talking to their physicians about anything, if there's a chance the government would be able to learn about it?

Forcing them to do it illicitly, or worse, leaving patients with no options but to seek out own solutions to problems. Of course, they could always get advice on the 'net - there's all kinds of good, healthy medical options to be found there. :rolleyes:

Thankfully, it seems as if my country might have a bit more common sense on this issue - makes me glad once again that I'm not American.
