Federal agencies are not simply the hands of the president, they have their own mission statements and agency-specific legislative directives to follow. W found that out; he met some resistance from the career civil servants and they usually had the law on their side.

That's all in general, of course; I don't know what authority Obama has over the DHS in this specific area.
