is an employment contract the same as

Any employment contract is what they ask you to agree to once they've offered you the job.

Basically, it should state that you're selling your soul and sexual services to the company to use as it sees best. Wait, that's just in New Jersey. Might be different where you are.

Someone offered you a job which you didn't apply for? Is this company company run by Yayati?
 
I'm so confused right now. I'm filling out a form for the labor board to make a claim for unpaid wages. one of hte questions is asking me if I signed an employment contract or agreement. I never filled out an application, and the only form besides tax forms I signed was to state the I read and understood the rules of the place. Would that form be considered the employment contract?

I talked with the manager cuz my best friend worked there at the time and had put in a few good words for me since I really needed a job. he told me come in on monday and fill out an application and you've got the job. I came in on monday and he said dont worry about the application, you dont need it. so I never filled one out.

yes, but human resources there is run by a 17 year old that screws up everything. she is the reason I have to fill out this form and have to wait up to a year before I receive my $265 that they were supposed to pay me in July

If you never signed something that implicitly stated your salary, days off alloted, number of bathroom breaks to be taken in any given day, type and colour of panties you can wear, whether or not you should wear panties, health benefits, overtime applicability, emergency leave and so forth, then you don't have an employment contract.


ps - the panties thing is only applicable in New Jersey.
 
Generally, when you are seeking a job you submit a resume and/or complete an application.

IF they decide to hire you the company MAY draw up an employment contract that states your terms of employment are and what your compensation and benefits will be. It will usually include provisions for what will happen in the event of termination of employment (by your choice or theirs..), non-disclosure agreements, non-compete agreements, etc..

The "rules" statement you signed may very well have been your contract. They may also not have had one.

Fill out your paperwork for the labor board checking the "No" box, give them copies of that paper you did sign and make a note that that was the only form you signed at any time. They can figure out if they want to consider it an employment contract or not.

then how come I had to sign tax forms stating my hourly wage? that in itself should be binding them to what we had agreed to orally for my wages and such. and there was a written agreement for the days off that I needed that I put in and the managers agreed to. the rules form that I signed said things in terms of not working more than 8 hours in a day, what type of clothing to be worn, etc.

I'm not sure if that qualifies as a employment contract, but alot of the components to it are there.


You've stumped me. I am useless to you now. Ask the HR person, maybe his/her HR manual says something about employment contracts.

yet another reason why I love New Jersey. Panties are always optional.
 
I doubt they have a HR manual. the HR person is 17 (i'm not kidding) and she screws up a whole lot and then tells everyone else it's their fault it's not right (typical teenager attitude). I really dont want anything else to do with them. I just want my money. I even gave them a chance to get it to me without this hassle, but they didnt. So I'm going through the labor board. I honestly hope they get shut down soon.
 
yup... that's how I got the form and I'm filling it out right now (the question I wasnt sure about is one of the ones on this form) so I can send it back in to them so this can be taken care of. I'm sick of fighting someone that refuses to listen. I still have a few other government departments I'm considering calling on this place but havent yet.
 
You're probably going to have to give alot of bjs before you get an answer. No.............wait, nevermind, again New Jersey.
