Of course, if Sotomayor passes away, Harris could simply leave the seat vacant until the Senate flips again. The Pubs can't squawk -- they set the precedent with Merrick Garland.

That worked for the Fascists because there was a 5-4 majority then everything was deadlocked at 4-4 which meant the USSC could not "legislate from the bench" as they routinely do now. An open USSC seat if Sotomayor passes away unexpectedly would give the Fascists an even stronger 6-2 super majority which would likely allow Alito more latitude to create new "laws" and strike down even more established precedent.
 
I did vote for some Republicans down ballot, though up top went Democrat.
