Supreme Court Thinks Neil Gorsuch’s Opinion On Disabled Kids Es Muy Asshole


In a rather unfortunate bit of timing, the U.S. Supreme Court today unanimously overturned a 2008 decision Neil Gorsuch wrote on the educational rights of children with disabilities, about 40 minutes into Gorsuch’s third day of confirmation hearings before the Senate Judiciary Committee.

The current case, Endrew F. v. Douglas County School District, involves the application of the Individuals with Disabilities Education Act (IDEA), which mandates that public schools receiving federal education funding must provide a “free appropriate public education” to students with disabilities. It was one of those narrow interpretations of the law “exactly as it’s written” that Gorsuch is so proud of, except, so sad, too bad, the Supremes unanimously rejected Gorsuch’s reasoning.


Beyond the smiling folksy charm, this guy really is a worthy successor to Antonin Scalia, a firm believer in the principle that the law is an asshole.
 
Bernie Sanders to say ‘no’ to Gorsuch

Sen. Bernie Sanders, I-Vt., confirmed Thursday that he planned to oppose Neil Gorsuch, President Donald Trump’s nominee to the Supreme Court, saying in a statement that the judge "brought the confirmation process to a new low."

The senator described Gorsuch's efforts to avoid revealing his stance on a number of critical issues as "a thick fog of evasion" that clouded his Senate confirmation hearing this week in Washington, D.C. Sanders' opposition was one of the first rebukes to follow Gorsuch’s hearings and could help provide a precedent for Democratic elected officials to vote "no" for the appeals judge's lifetime opportunity to serve on the highest court in the nation.

I expect Gorsuch to be approved by the Senate. It may be close, but the GOP has enough votes to do it.

I saw part of the hearing. What some of the senators were doing was asking the nominee to rule on current issues without hearing any testimony. :eek: Of course, he refused to answer questions like that.

Suppose the Trump admin has been colluding with Russia. Suppose also that Gorsuch is in on the deal. Could we be on the verge of having a Supreme Court that is 1/9th Russian mole?

It's unlikely the two entities you mention will say anything negative but, if they did report rumors as fact, Trump might file a suit. Or, do you know any actual improper contact between Trump and the Russian government?

The last four Democratic votes needed to vote in the Cloture Wars were Dianne Feinstein of California, Patrick Leahy of Vermont, Christopher Coons of Delaware, and Mark Warner of Virginia. Leahy, the longest-serving member of the Senate, called Gorsuch’s answers to questions during his confirmation hearings “excruciatingly evasive,” which seems a bit nicer than really necessary.

“I cannot recall a nominee refusing to answer such basic questions about the principles underlying our Constitution and about how he interprets those principles,” Leahy said. “These are fundamental questions that we should ask every nominee seeking a lifetime appointment to our highest court.”

Leahy also said he was sorry the filibuster rule would likely be pitched by the end of the week to install a Justice few Democrats can stomach, but that doing what he could to stop Gorsuch was more important than preserving a Senate tradition.

“I cannot vote solely to protect an institution when the rights of hard-working Americans are at risk,” he said, “because I fear that the Senate I would be defending no longer exists.”
 
Soon the Supreme Court will be down to seven Justices, and Congress can then simply change the statute, so that seven is all that are needed. Kicking the can down the road is what they do best.
 
Senate Republican leader starts clock ticking to showdown on Gorsuch


Senate Republican leader Mitch McConnell said on Tuesday he would soon file a motion seeking to cut off an expected Democratic filibuster of Supreme Court nominee Neil Gorsuch, setting the clock ticking toward a showdown vote later in the week.

The motion would set up a vote, likely on Thursday, to try to cut off the filibuster, which would require a super-majority of 60 votes in the 100-seat Senate to end debate on Gorsuch’s nomination and move to a final up or down vote on confirmation.

Enough Democrats have agreed to support a filibuster to block a final vote under current Senate rules, and McConnell is expected to seek a rule change to get the nomination approved by Friday.
