A judge sentenced a 19-year-old man to three years in prison Wednesday, the minimum possible term, in the Dec. 20 shaking death of his 6-week-old son.
Charles A. Andrews wept in front of Judge Michael Tucker as he offered apologies to his son’s mother, Deanna Duncan, and her family.
"I’ll trade everything just to have my son back," Andrews said through his sobs in Montgomery County Common Pleas Court.
Seconds earlier, Duncan told Tucker, "The boy was so precious and sweet for the short time that I had him. It was great."
And to her son’s father, Duncan said, "I would say hopefully you think twice before you react."
Andrews pleaded guilty July 3 to involuntary manslaughter in the death of Charles A. Andrews III.
Andrews told investigators he had been watching the baby, along with a toddler and a 5-year-old, while the infant's mother was shopping with her mother.
The infant died Feb. 12 at Children's Medical Center.
Julie Kraft, assistant county prosecutor and chief of the child abuse bureau, asked for more than the minimum prison sentence.
"The defendant stated that the baby had been fussy all day and that the two other children had been acting up," Kraft wrote in a memorandum to the judge. "The defendant stated that he lost his temper and his patience. The defendant admitted that he picked Charles up and started shaking him, that he shook him several times. In his written statement, the defendant added that he grabbed the baby by the neck."
Andrews told police the baby’s eyes rolled back into his head and he started gasping, stopped crying and then stopped breathing, Kraft said. Andrews demonstrated what he had done on a life-sized doll while police recorded him on videotape, Kraft said.
Andrews’ attorney, Charles G. Andrews of the county public defender office (no relation to the defendant), asked for probation.
The 19-year-old has been receiving psychiatric care and has been diagnosed with post-traumatic stress disorder and anxiety disorder, the defense attorney said in a memorandum to the court.
Tucker said the issues in the case tugged at him so strongly that he waited until each participant addressed him before deciding whether to impose the minimum prison sentence or a longer term. He even allowed the defendant’s father, Charles A. Andrews Sr., to make a statement on his son’s behalf.
Tucker said Andrews’ lack of a prior criminal record and lack of other negative factors supported his conclusion to impose the minimum.
"I know it was not your intent to take your son’s life," Tucker said, "but I cannot overlook the fact that your acts caused your son’s death . . . there are consequences to actions."
Attorney Andrews said he would seek an early judicial release from Tucker after his client served six months in prison.

this fucking stinks! I think our justice system needs to be looked at and have an overhaul. Seems like murder and manslaughter,rape, etc...the person gets off/out in just a few fucking years....but then some other crimes where noone was killed or violated they get life in prison. I know that this boy is young, I would never have left a baby that young with him, let alone with 2 other small children. I assume that the mother was young, too. But regardless of their age, people need to learn some patience and how to deal with kids! And everyone needs to stop shaking these kids! They have shown what happens to their brain when shook, it just rips it apart.
