Critics of this attack on LGBT people have noted both online and off that if gay marriages are now without legal standing in Canada if the couple’s homeland forbids them, are Middle Eastern women living in Canada now stripped of their rights to vote, drive a car, or even show their hair? Is being gay now punishable by death in Canada if you’re from Uganda? Is blogging or criticizing your government now illegal for Egyptians living in Canada?

Jesus, that's a serious legal can of worms.

I think Savage's comments in the link are probably right. He's funny, too; "I have to go wake up my husband and tell him we got divorced last night."
 
The problem with the Gay marriage thing is that though couples from outside Canada can get a licence to marry a problem arises when they decide to get divorced. Since Gay marriage is not recognized at their point of residence, where they are supposed to apply, that option is void.

If they come back to Canada looking for a divorce they are thwarted by a law that requires a year of residency in Canada before it can be granted. Some Judges are apparently willing to waive this technicality and send them on their way but the legal system still has a glitch in it.

Otherwise Canadian law over rides all other laws, religions, cultures etc. One country united above God I like to think. :D
 
That suuuuuucks. What a betrayal. So many gay couples moved there specifically because they could get married.

I doubt it will take long for Canada's government to reverse this little development, and close the loophole that this Gaudet fellow has tapped. They sort of have to. If they don't, and this precedent (which is nasty enough by itself) stands, it's only a matter of time before it's exploited in other ways.

Our government should have sorted this legal bullshit out before they ever legalized gay marriage. I think what our government is doing to foreign couples right now is shameful.

Thing is that people are coming from other jurisdictions, getting married, then returning home where the marriage is not considered legal.

Its been years since the legislation was passed so you would figure that glitch would have been corrected by now.

Possibly the problem is political. The legislation was passed by a Liberal government. I think the present Conservative government is anti gay marriage but is unwilling to move against Public Opinion to reverse it. Could be a reason for the foot dragging.

The public seems to think so. It should have been done right in the first place but on the other hand it was passed in 2005 and should have been fixed up by now.

Heard the Justice minister on the news this evening claiming that the marriages are legal and the problem will be fixed. On the other hand there is a case going in Toronto involving a woman from Florida and a woman from the UK. The Crown is arguing that the marriage is not legal because it is illegal in both those jurisdictions. :confused:

Could be fixed up easily enough, I think.

Yeah I caught that on the news too. Sound like this nonsense could be fixed by simply removing the one year residency requirement for a divorce.

That's about all there is to it. IMHO

I am wondering where the law comes from. I had never heard of it till now. It sounds like a quickie-divorce prevention law of some sort. Could also be an English law that was just transferred into Canada's books.

In any case the Same sex marriage laws are going to look like a scam untill this is repaired.

The one year residency requirement for divorce was put in place to help combat immigration scams. I'm sure you have heard of fake marriages between Canadian citizens and foreigners to get the foreigner landed immigrant status. In theory it helps to prevent marriage followed by a quick divorce after the immigration process in complete.

I personally question how effective the law has been since its not really a big deal for them to stay married for year. Other requirements for immigration through marriage have been intruduced in recent years that make the law obsolete.

Sounds like that would be it. In the present situation though it is clearly just a rather embarassing obstruction to a fair deal.

Hopefully it will be resolved quickly and the whole issue put back on the shelf.
