What are yours?

I want to sue the makers of 3-D movies and pictures, I'm physically unable to see them.

Newsreaders (and newspapers and magazines too for that matter) for the pain and suffering caused by the continued use of lame and juvenile puns*.





*Actually I would prefer the Monty Python solution, applied the moment the pun is uttered.

I read once that a guy successfully sued a car manufacturer after crashing his mobile holiday home, injuring himself and his wife. He had put it on cruise control and then gone into the back to make a drink. He asserted that the manual did not stipulate that he had to continue steering once cruise control had been engaged.

Frivolous lawsuits? How about mass injunctions on GB posters to stop them infiltrating other forums? Or open season on trolls?

to assume coffee isn't hot is foolish...they had a similar case around that same time in britain and they ruled it was silly.

idk though i dislike all cases where common sense could have prevented the incident. she burnt herself cuz she couldnt hold her cup still, spilled her drink, and left the hot a** sweats on.

I have not read the court opinions myself, but I heard several things:

1. The payout was massively reduced during subsequent appeals such that the plaintiff didn't significantly profit from her lawsuit.
2. The defendant had actual knowledge that their coffee was way too hot. There was no need for the coffee to be as hot as it was and no other fast food chain served their coffee that hot. The defendant was warned to reduce the temperature of their coffee, but ignore such warnings.

Using a saw is dangerous, but that doesn't mean the manufacturer of the saw has the the defense of "well, everyone knows a saw is dangerous" when someone gets hurt when the saw is defective or otherwise made more dangerous than it has to be.
 
yea i cant remember the details. lol i wiki'd it yesterday after posting so i remember it did drop to a settlement of around 600k but i feel that because she spilled it on herself it shouldnt count.

if she dropped it cuz the cop was too hot maybe, and if she was extremely burnt while drinking perhaps...but she spilled it on herself and let it cling on her skin instead of taking care of the situation.

lol i'd rather ride without pants than just be in pain waitin til i get 2 a destination.

On February 27, 1992, Stella Liebeck, a 79-year-old woman from Albuquerque, New Mexico, ordered a 49¢ cup of coffee from the drive-through window of a local McDonald's restaurant. Liebeck was in the passenger's seat of her Ford Probe, and her grandson Chris parked the car so that Liebeck could add cream and sugar to her coffee. She placed the coffee cup between her knees and pulled the far side of the lid toward her to remove it. In the process, she spilled the entire cup of coffee on her lap.[9] Liebeck was wearing cotton sweatpants; they absorbed the coffee and held it against her skin as she sat in the puddle of hot liquid for over 90 seconds, scalding her thighs, buttocks, and groin.[10] Liebeck was taken to the hospital, where it was determined that she had suffered third-degree burns on six percent of her skin and lesser burns over sixteen percent.[11] She remained in the hospital for eight days while she underwent skin grafting. During this period, Liebeck lost 20 pounds (nearly 20% of her body weight), reducing her down to 83 pounds.[12] Two years of medical treatment followed.

One and a half minutes. She did not "wait till she got 2 a destination". She was old, she was unlucky enough to be wearing cotton pants, and it took her a minute and a half to get help.

Additionally, it's totally unreasonable for coffee to be served at 190 degrees, at all. Go ahead and heat yourself some coffee to 190 -- we'll wait! -- and then drink it. Tell me that's not going to hurt.

Nobody argues that she didn't make her own mistake spilling the drink, and indeed the facts of the case point out that she shares fault. Honestly, if you're going to ruin a perfectly entertaining thread concept by dragging out old stuff, at least try to know what you're talking about.

If that were -my- grandmother, I'd sure be pissed. I'll bet you would be, too.
 
i told u i wiki'd. my opinion doesnt change. it was a stupid lawsuit. if my grandmother had this happen i would be disappointed in her. at the end of the day, you should know what you're capable of. i hear the elderly say 'i'm too old for that' all the time. and nobody upset but you..you not feeling me fine, it cost you nothing pay me no mind
 
Any sane and rational individual knows the difference between frivolous and negligence. For everything else there's lawyers and the politicians. :rolleyes::D
