A former deputy chief of staff to New York Gov. Kathy Hochul was charged Tuesday with acting as an undisclosed agent of the Chinese government, federal prosecutors revealed in a sprawling indictment.

Linda Sun, who held numerous posts in New York state government before rising to the rank of deputy chief of staff for Hochul, was arrested Tuesday morning along with her husband at their $3.5 million home on Long Island. Sun and her husband, Chris Hu, are expected to make an initial court appearance Tuesday afternoon, a spokesman for the U.S. attorney's office in Brooklyn said.

The FBI searched the couple's $3.5 million home in Manhasset late July but declined to release further details at the time.

Sun worked in state government for about 15 years, holding posts in the administration of former Gov. Andrew Cuomo and eventually becoming Hochul's deputy chief of staff, according to her LinkedIn profile.

According to U.S. Customs and Border Protection (CBP), in the first three months of this year, 24,376 Chinese nationals were apprehended crossing the U.S. Southern Border, while about 1,000 have been crossing the northern border monthly. Under the National Intelligence Law of the People’s Republic of China (PRC), all Chinese citizens and entities are required to assist the Chinese Communist Party (CCP) in intelligence gathering. The threat from China is real, pervasive, and growing, as Beijing exploits America’s open borders and freedoms to plant spies within the U.S. government, military, research labs, and institutions.

In September 2024, Linda Sun, a former aide to New York Governors Andrew Cuomo and Kathy Hochul, was arrested for acting as an undisclosed agent for the Chinese government. She is accused of leveraging her position to further Chinese interests by influencing state policies and facilitating meetings between Chinese and U.S. officials. Sun’s case reflects a broader strategy by China to infiltrate U.S. political systems by targeting state and local officials. The Ministry of State Security (MSS) often exploits naturalized U.S. citizens with ties to China, using business opportunities and family connections to gain influence. Sun’s arrest underscores China’s efforts to influence rising political figures and manipulate policies, including those concerning Taiwan, through covert operations.

The Annual Threat Assessment from the U.S. Intelligence Community identifies China as the top espionage threat to the United States. The FBI’s China Threat Report highlights that counterintelligence and economic espionage activities by the Chinese government and the Chinese Communist Party (CCP) pose a significant danger to U.S. economic security and democratic values. China’s goals include influencing U.S. policy to benefit its interests while striving for global dominance through tactics such as intellectual property theft, cyber intrusions, and predatory business practices. These efforts span various sectors, including business, academia, and government, necessitating a coordinated response from both the U.S. government and private industry to effectively address the threat.

The China-Democratic Party connection goes back at least to 1996, when key campaign donations raised with the help of a Buddhist nun were tied to some technology sales to Beijing under the Clintons. It's nothing new there. I'm not saying that the bulk of Democrats are pro-Beijing, certainly there are critics, but there is no doubt that, much like Trudeau, the Clintons and some top Democrats are very cozy with the CCP. That might be part of the gradual Clinton-Trump split, when they used to be friends, once Trump became vocally anti-China.

Honestly, this problem of foreign influence is so old that it's part of the reason behind the Emoluments Clause in the Constitution. British and French agents kept pushing to influence even certain of the Founding Fathers, such as Edmund Randolph and Alexander Hamilton. Arguably the best argument for impeaching Trump, which I supported when Congressman Green proposed it early in his administration, was due to alleged breaches of the Emoluments Clause while still President-Elect, though it's questionable about whether or not it applies before someone even takes office.

I presume she's innocent. That however doesn't take away from the fact that she's been arrested and has a history of connections to China's ruling elite. Whether that's enough for a conviction is something we'll have to wait to see.

If, that is, she remains in the US after being released on bail.
