Federal judge blocks California ammunition purchase background checks

A federal judge on Thursday blocked a California law requiring background checks for people buying ammunition, issuing a sharply worded rebuke of "onerous and convoluted" regulations he said violate the constitutional right to bear arms.

U.S. District Judge Roger Benitez in San Diego ruled in favor of the California Rifle & Pistol Association, which asked him to stop the checks and related restrictions on ammo sales.

"The experiment has been tried. The casualties have been counted. California's new ammunition background check law misfires and the Second Amendment rights of California citizens have been gravely injured," Benitez wrote in a 120-page opinion granting the group's motion for a preliminary injunction.

Unfortunately, California asked for and received an "emergency" stay on the injunction from the 9th Circuit Court of Appeals within hours of the ruling being issued and their "demand" to the judge to stay his decision was denied.

The "emergency stay" is an administrative level stay, which means the the appeals court will rule within 21 days on changing the emergency stay into a permanent stay until the case is fully adjudicated after all appeals are exhausted.

The injunction is from the trial court judge saying that the state can't enforce the law.

The stay is from the appeals court to preserve the status quo until they can review whether the trial judge abused his discretion in issuing the injunction.

An injunction is issued whenever the complaining party is "more likely than not to prevail on the claims made in the complaint".

The injunction doesn't end the case. However, getting one imposed against you indicates whether you should continue to defend the matter or settle/concede.

The troubling thing in this case is that there an almost certainty that the appeals court will make their stay permanent pending final resolution of the case. Even if the trial judge ultimately decides against the State based on the evidence, the State will appeal and the emergency stay will continue in effect.

Thus, even if the complaining party wins, they still lose because the illegal law is still allowed to be enforced.

Justice delayed is justice denied. This is how unconstitutional law is allowed to exist for the years it takes to be resolved by the SCOTUS, if ever. The law is clearly an infringement on the Second Amendment and unconstitutional on it's face. Very disappointing.
