There's a major capitulation by the low information voter to the existence of the emerging post constitutional republic and it's surveillance state.

The Constition doesn't prevent a surveillance state. Privacy is at best implied. You can claim it's a strong implication but for someone who's constantly asking where does the Constitution say that this is an interesting argument to have.
