‘It’s the First Amendment, stupid.’ Judge tells Florida to stop threatening TV stations

A federal judge ordered Gov. Ron DeSantis’ state Health Department to stop threatening television stations with criminal prosecution if they kept running ads in favor of an abortion amendment on the ballot next month.

In a sharply worded ruling on Thursday, U.S. District Judge Mark Walker rebuked the DeSantis administration for trying to quash what he called constitutionally protected political speech.

“To keep it simple for the State of Florida: it’s the First Amendment, stupid,” Walker wrote, granting a request for a temporary restraining order. A hearing for a preliminary injunction is scheduled for later this month.

The ruling puts a temporary halt to one of DeSantis’ most brazen attempts to defeat Amendment 4, which would overturn the six-week abortion ban he signed into law.

I think abortion on the ballot will tip Arizona and Nevada to Harris. Florida too, but nobody else seems to believe that.

Gotta vote.
There's also a Florida ballot initiative to decriminalize recreational marijuana. Like abortion, its presence on the ballot will turn out more Dem than Pub voters.

Otherwise it would seem to be a long shot -- lotta conservative old folks in Florida.

OTOH, this is already a state where you can't hardly find a strip mall with no smoke shop in it.

Also the Baby Boomers are moving into retirement now. In a few years the common room of every nursing home in Florida will be hung with day-glo posters, with Jimi Hendrix playing on the PA, and oh my, what's that smell?! It ain't patchouli!

Tennessee court rules doctors who provide emergency abortions can’t be disciplined

Three judges in Tennessee issued an injunction that temporarily protects doctors in the state from being disciplined for performing medically necessary abortions.

The temporary injunction was issued Thursday in response to a lawsuit filed more than a year ago seeking to stop Tennessee’s abortion ban and require officials to clarify the “medical necessity exemption” under the current law.

“The court finds that the issue of which conditions, and the timing of when they present and escalate to life-threatening conditions, constitute medical emergencies within the Medical Necessity Exception is demonstrably unclear,” the lawsuit reads.

The judges’ ruling outlines a set of conditions that now qualify as medical exemptions to the state’s abortion ban including premature rupture of the amniotic sac before birth and fatal fetal diagnosis that could lead to infection, uterine rupture or loss of fertility.

but it's not all good news:
The judges said because the ruling is being made in a chancery court, they do not have the power to entirely block the criminal statute in the state’s abortion ban.

So, while doctors are protected from having their licenses revoked by the state medical board, they could still face criminal charges if they perform abortions deemed not medically necessary
still, a move in the right direction
