Can I use characters, themes, and character personalities, etc. and avoid facing copyright issues.

Im wondering because I have an idea for a few short stories, that I plan to post, about a few of the minor student characters from Harry Potter.
Or would it be enough to site that characters and personalities taken from their books I the credits????

Harry Potter yall. Obviously nonsexual. Gods I shouldn't have to say that last part.
 
Do you honestly believe someone is going to come after you because you used a public character real or imaginary?

I also get a kick out of all the authors that post their work is copyright and blah blah blah. People, it isn't!

Under U.S. copyright law, copyright inheres at the moment a creative worked is fixed in a tangible medium. Court decisions have found that electronic publishing counts as fixed in a tangible medium. As such, registering a copyright is not necessary for a work to be protected. Therefore, stories published here are protected by copyright.

However, enforcing a non-registered copyright is very difficult, and also damages are unlikely if a work distributed for free is infringed.

Or so my lawyer (who is also my Hubby) told me when I published my story here. šŸ˜
