Hi all,

I'm thinking of starting a wordpress site and uploading captions, i.e. porn pictures I find online and adding text to them.

I was just wondering is that legal? Additionally, is it okay to photomanipulate porn photos too for caption?
 
The Internet is full of captioned porn photos and mini-vids. Is it OK? It’s probably infringing on copyright, but I can’t imagine prosecutions are common.

In principle, copyright applies to porn as much as any other image. So, no.

Also, having a porn site may be against the T&Cs of the host.

Plus, you would have to engage with the porn laws of multiple countries.
 
Seeing there's countless porn threads on Reddit and IMGUR and those places I don't think the legality is an issue. But what wordpress TOS is I have no idea. I also think that you can only post it as a link and not an actual pic like they made it here recently.

Many hosting companies, including WordPress itself, offer WordPress. You need to review the TOS for each to determine whether they would allow a porn+WP site. I think some hosting companies specialise in hosting porn sites.
 
You MAY be able to get around the copyright issues through parody or other claims that the use is transformative... if the pictures are no longer being used for their original purpose (titillation) but for something else. Of course the only way to know for sure is to try it. You don't get prosecuted for copyright issues, it's civil, not criminal law, but if the right's holders for those images send a cease and desist any host you have is probably going to make you take them down, or cancel your account/service.
As Lovecraft said, you need to look into the TOS on the site you want to use as well. People are getting pretty cautious these days. Plus, if you don't know the origin of the pictures, you have no way to ascertain the age or consent of the people in the pictures.
 
I was curious and checked. Wordpress is okay with porn.
WordPress the software, or WordPress the hosting service.

I would expect them to be silent on the former, and be against on the latter.

However, there are limitations to the mature content permitted on our service. You can not:

  • Post visual depictions of sexually explicit acts (such as, but not limited to, images, videos, and drawings) that can be considered sexually explicit.
  • Post links or ads to adult-oriented affiliate networks, such as sexually explicit site signups.
  • Post links, text, or images promoting or advertising escort or erotic services.
  • Post images of extreme violence or gore. Exceptions may include posts which relate to world events, and which have associated context or commentary.
  • Post images of child sexual abuse material, sexual extortion, and grooming.
  • Post content that promotes pedophilia, such as sites with galleries of images of children where the images, content surrounding the images, or the intent of the blog is sexually suggestive.
In other words, they do not permit hard-core porn on sites that they host, or that use their Jetpack service.

Which means that you could use WP for a site which uses content that WP itself does not allow. You still have the TOS of the actual host to consider.
