Jury Deadlocks In Sex Abuse Case

STILLWATER -- A Payne County jury deliberated for more than six hours Wednesday before announcing it was deadlocked in the trial of a Cushing man who was accused of committing lewd acts on a 10-year-old boy in Stillwater earlier this year.

District Judge Donald Worthington declared a mistrial after the jury composed of seven men and five women said that it could not reach a unanimous verdict in the case of Cornell Maurice Mukes, 39.

The judge scheduled a Sept. 19 hearing at which a new trial date could be set for Mukes, who remains in the Payne County Jail in lieu of posting $250,000 bail.

Stillwater Police Sgt. Jeff Watts testified at the two-day trial that Mukes had admitted committing various sexual acts with the 10-year-old boy, while Mukes was 38.

"He told me all of the sexual contact was initiated by the boy," Watts testified Tuesday.

The detective told jurors that Mukes made those statements during a 30-minute interview about 2 a.m. April 10, while Mukes was in a hospital bed at Stillwater Medical Center.

Mukes had been taken to the SMC emergency room after the boy's father beat Mukes in the head, according to court testimony.

Mukes was transferred to the University of Oklahoma Medical Center, from which he was released about four hours later, Watts testified.

Mukes had been beaten by the boy's father after he learned about the alleged sexual abuse of his son, police said. Mukes was arrested in Cushing after he got out of the hospital, police said.

In addition to being charged with four counts of lewd acts to the 10-year-old Stillwater boy, in whose home Mukes was staying earlier this year, Mukes was also charged with raping a 6-year-old Cushing girl, to whom he is related, more than 10 years ago.

Mukes has been ordered to stand trial on two counts of rape by instrumentation of the girl and one count of performing lewd acts on her, all during October 1997 in Cushing.

If convicted of all counts, Mukes could be given as much as two life prison terms without parole, plus 100 years in prison.

The arraignment for a man charged with intimidating a witness in a sexual assault case has been continued until August.

Jerome Dean Mukes, 64, Cushing, is charged with intimidating witnesses in a case in which his son, Cornell Maurice Mukes, is charged with committing lewd acts on a 10-year-old boy earlier this year and raping a 6-year-old girl in 1997.

Jerome Mukes appeared in Payne County District Court on Thursday for arraignment, but did not have an attorney.

The court continued the arraignment until Aug. 5 at 1:45 p.m. for Mukes to appear with counsel.

In an affidavit, Stillwater Police Officer Jeff Watts stated that before a preliminary hearing for Cornell Mukes, Assistant District Attorney Tom Lee told him that two witnesses in the case had been threatened and harassed by Jerome Mukes.

After the hearing, Watts stated, he interviewed the two at the police station, and the mother told him that Jerome Mukes had telephoned her house and told her to quit telling lies about his son. She said he cursed at her then and another time when she saw him at a convenience store and again on June 1, when he came to her house and told her that she and her daughter needed to “keep their mouths shut,” the affidavit states.

The daughter told Watts that Jerome Mukes had tried to talk to her at the preliminary hearing, but she didn’t speak to him and also that she was not a witness to anything he said to her mother, according to the affidavit.
