take Dawn from Buffy for instance

not only is the charcter underage
but so is the actress
at least where I live

But you can have stories staring the underage princess
and nobody will bat an eye

So what do you think about using underage charcters in Fanfiction

I once tried to post a story to Literotica in which one of the characters was 17. She was based upon a cartoon character. It was still rejected.

Literotica and CHYOO are not run by the same people, but they seem to be closely affiliated and so therefore CHYOO would probably view such a thing in much the same way, regardless of how "real" the character is or the laws in your area.

Legality has nothing to do with it, actually - there are no laws that state one couldn't write a story about sex between five-year-olds. It's a rule imposed by the webmasters of CHYOO and Literotica, and therefore it is one that they may enforce as they will. Ultimately, it's their site, their rules, and they are perfectly within their rights to reject a story just because they're having a lousy day.

Short answer - no, there are no exceptions. If you want to write a story about sex with Dawn and post it here, she will need to be at least eighteen.

By the way, who is "the underage princess"?

Mine may have been rejected because at one point in the story I specifically mentioned that my character was a high school junior, which implied that she was 16 to 17 years of age.

I know exactly who Dawn is (She buffy sister. Me gystex. You lilguy. Got it.) My question was, who is "the underage princess" to whom you refer? And if it's Dawn, then where are all the supposed stories about her that flaunt her being underage? Considering the zealousness with which people around here hunt the pedophiles, I'd be really surprised to know there's a story on CHYOO which makes a point about her being under 18.

Actually, Dawn brings up an interesting point. If I understand the character correctly, she wasn't actually born like a normal person - she was magically conjured in some way. This means that technically, she's only one year old when she looks 15. What do we go by, her actual age or the age she appears to be (and believes herself to be)? Assuming the latter, the last couple of seasons of Buffy do indeed feature Dawn over age 18, so she would be "legal". Come to think of it, I can't remember if her age is ever brought up on an episode of "Buffy".

As for Judy Jetson, I don't think her age is ever specifically given, so she also may well be 18 as long as the author doesn't say otherwise. Benefit of the doubt applies.

For an example that's not about TV characters, take "Population Crisis" by Inkybus. This is a story all about high school students nailing each other, but since none of them are actualy specified as being underage, we can assume that they are over 18. I don't think this story has ever generated any complaints about the age of its characters.

In the end, if you're not obvious about using an underage character, I think CHYOO will assume that you know the rules and are following them.

Well the thing is for people to click on fanfiction..change are they familar with the character

so wouldnt they be familar with the age of the charcters even if you don't come out and say it.

I mean granted I never seen it flaunted. But come on. It look like they know

also the undeage princess I mention was Dawn.

I have read fan fics involving the characters from anime like Ranma 1/2, where a lot of the main characters are 16 or 17. I have also seen some involving Sailor Moon, who goes from 14 to 18 over the run of the show, but is dating a guy in his 20's.

However, none of these were on CHYOO. Some also state that they took place after the series, when the characters had aged to 18 or older. For the most part, when they say no stories about minors, that means no stories about minors. Some still slip in now and then (usually in later threads), but they are still taboo.

My Understanding.

The way I understand it, is that none of the characters in a story may be underage. By that I'd assume you could use real people such as Mary-Kate and Ashley Olson, but if their age isn't stated then it would be fine. But if you say they're under-age, then you deserve to have the thread yanked.

But like it has been said before, if the moderators want to reject it, they can do whatever they want.

Also, being a website, the stories that are put up would probably be considered published. Therefor if a story had underage characters it would probably be considered childporn, and that is illegal. It's something interesting and I'd be interested in learning more. Anybody who knows the laws of this, or wants to look them up, let us know what you find.

I'm not a legal expert, but I can tell you what the CHYOO webmasters told me on one miraculous occasion when they actually wrote me back after I complained about an obvious underage thread. What they said was that their policy of no underage characters was theirs alone, and that there is no law forbidding it. You can legally write and publish a story about sexual contact between children - though why anyone with an undiseased mind would want to is beyond me.

Child porn laws refer to images only, not words - and not just any images, but only ones wherein there is some kind of sexual activity. It is legal to take a photograph of a nude child - for instance, in the Sports Illustrated 25th Anniversary Swimsuit Issue, there is a picture of Christie Brinkley in bikini bottoms, with her back turned to the camera, and her four-year-old daughter buck naked standing next to her. Nothing illegal about it! Michael Jackson was found to have a book of photographs of nude children in his posession - again, it is not illegal, though it certainly raises eyebrows about his tastes in bed partners.

It is not legal to take a picture of a man stroking his dick in front of a child, clothed or not. It is not legal to take a picture of a fourteen-year-old boy with a hard-on. The lines are occasionally fuzzy, but that's what we have courts for. This is how I understand it.

Not to open a can of worms, but I think one of the biggest problems in society today is the discrepency surrounding when one is an adult as opposed to a child. There are states where the age of sexual consent is 16, but one can't pose for a sexually explicit photograph until one is 18. Think about what this means - it would be illegal for a 17-year-old to fake having sex in front of a camera, but they could have real sex with the photographer and that would be fine. A sixteen-year-old may legally go through the motions of getting pregnant, but must have her parents' permission to get married. I wrote a story about 17-year-old girls having lesbian sex (which was, naturally, rejected by Literotica) but there would be nothing illegal about my actually having sex with a 17-year-old girl, were I not married. The mind boggles.

Why can't we figure out when the hell someone becomes an adult? Is that too much to ask of society?

If Lilguy is talking about the stories I'm thinking of I just had a quick look and the two I found where Dawn was involved both had lines saying "Dawn had just turned 18 and...." or words to that effect.

As I understand "Age of concent" laws, which do vary from state to state, it's something like this. Since 16 year olds are going to be haveing sex with each other, why keep it illegal? So they make that ok. However, a non-minor can't have sex with a minor, enless they are fairly close in age (In PA I heard once that it was less than 4 years differance. So a 16 year old, could be with a 20 year old if they had the same birthday, but no greater differance.). People under the age of consent having sex with anyone, regardless of their age, is illegal. So in a state where it's 16, a 16 year old may not have sex with a 15 year old, not even a day short the 16th birthday.

I remeber looking up the ages of concent in differant states once, and some were as low as 14 for girls, but 15 for boys. Also I saw a thing on 20/20 once about Mormon Polyigimsts. This guy in his 40s or 50s married a 15 year old girl, because he got her mother's permision, and that was legal... well except he was still married to that girl's mother, which is why she gave permision. Anywho, if you're an old freak, you can legaly have sex with a minor, BUT you have to marry her FIRST for it not to be statutory rape.

In conclusion... umm... Always check for ID.
