The smart thing for Bush to do is to quiety ask Sandra Day if she would like the slot, and to offer it to her if she does. It's the peace offering to the Left that'll let him get Roberts in without anything resembling opposition. But he probably won't, and she'd probably say no.

That would be about the same as Israel giving land in exchamge for peace.

Bush is still the President, so in theory he can nominate anyone he wants. No matter who he nominates (unless it's Hillary or Bill) are going to stir up a shit storm on the left side of the aisle.

? What I'm trying to say is that if he appoints Sandra to be Chief, if the Dems go after Roberts he can run wall-to-wall attack ads "Bush appointed Sandra Day O'Conner to be fair and balanced. But the Democrats in Congress would have none of it! FUCK THEM!" And you know something? He'd have a point. And it'd be a DEADLY effective campaign.

If he appointed Sandra Day, the Dems wouldn't have a leg to stand on in going after Roberts.
 
He's not gonna try elevating Thomas or Scalia to Chief because to do so requires that they step down from being an ordinary Justice and then go through the approval process in the Senate. Which means he'd essentially be risking another conservative bench position to a filibustering Senate. He'll pick a person from outside the Court I'm sure. As far as O'Connor, she stepped down to be by her husbands bedside due to his deteriorating health, it would be silly to offer her the high seat when she was quitting over family issues. This is going to be a logistical nightmare I think.

Rhenquist being replaced with a conservative isn't going to make much of a difference since he is a conservative.

Rehnquist was conservative, but he was also honest, forthright, and respected precedent.

Replacing him with a more vicious, even more conservative, and 4 decade younger dittohead *will* change things.

This post actually exemplifies what I mean about the Republicans. I said what I thought the smart move would be, but that I didn't think Bush would do it (I didn't say so, but I think that he wouldn't do it for ideological reasons).

Ish immediately responds with vicious personal attacks, but doesn't actually offer a different idea. His entire strategy, like the Republicans, is on slinging mud, then using the mud-covered post-battle terrain to try to express the idea that there's so much mud that both sides must have slung.

He says as long as she is there, Bush should be in no hurry to appoint a judge, which is what the Democrats want; to drag this process out as long as possible in the hopes of having a "friendlier" court on some upcoming rulings and with the passing of the Chief Justice it gets a helluva lot friendlier if they can maintain the status quo...

Beats winning elections!
