On April 21, the Senate Select Committee on Intelligence released a report on its review of the Intelligence Community Assessment (ICA) drafted for President Barack Obama on Russia’s interference in the 2016 election.

Corporate media immediately touted the Republican-controlled committee’s finding that “the ICA presents a coherent and well-constructed intelligence basis for the case of unprecedented Russian interference in the 2016 U.S. presidential election,” including by hacking Democratic National Committee emails, as vindication of the intelligence communities’ handling of all things Russia. But a close reading of the report—or at least those portions of the report that could be read—instead cements the reality that the FBI intentionally snowed the FISA court to spy on Donald Trump.

So far on every Democrat narrative concerning Russian collusion by Trump or his campaign, obstruction of justice, quid pro quo, Ukraine, the border, immigration, Syria, impeachment, Deep State malfeasance, we have been right and they have been wrong.

I think Sullivan is constrained by legal precedent, namely Rinaldi v. United States 1977 which addressed a courts authority to deny a dismissal of charges under Rule 48 which basically says finding no impropriety in the dismissal motion it should be granted.

The DC Circuit Court in 2016 has defined Rinaldi more broadly, it established the "leave of the court" language was decided as to be within the prosecutorial discretion of the executive branch, saying Rule 48(a) itself does not confer “any substantial role” for courts in determining whether charges should be dismissed. Instead it narrowly defined the courts duty was to shield defendants against prosecutorial harassment through repeated efforts to file and then dismiss charges. The D.C. Circuit explicitly rejected the notion that “leave of the court” language allows judges to deny a motion to dismiss based on its belief that the defendant should stand trial.

Sullivan could however demand an explanation of events that fueled the motives behind the motion, but in the end I think he has to grant it.
