I'm waiting on Sotomayor to announce her retirement and be replaced very quickly before Jan.

Otherwise there's a real chance the SCOTUS could be 8/2 conservative majority. Which should put the twist in a lot of anti-2A panties.

Never could stand her. By accident, I got to listen to her confirmation hearing on the radio on some road trip or another. That would have been Chuckie-n-her having their "Wise Latina" conversation.

Joe will have to wait until Congress recesses in Dec to make an interim appointment. Just like how we got Roberts as Chief Justice.

And we all know how well that's been working out.

If he appoints while Congress is in recess, there's no confirmation required.

It's a narrow window of only a week or so.

Absolutely. Bush appointed Roberts as an interim appointment. He became Chief Justice immediately. When Congress came back after recess it was already fait accompli and Congress really had no choice except to confirm pro forma.

It would be the same for Sotomayor's replacement. Already installed and working as a SCOTUS justice. No one is going to toss the replacement out on her DEI rear no matter how much they want to.

Among them, Roberts stood out for his experience as a Supreme Court advocate, which had brought him the favorable attention of not just conservatives but also liberals such as Ruth Bader Ginsburg.[88]

On July 19, 2005, President Bush nominated Roberts to the U.S. Supreme Court to fill a vacancy to be created by the impending retirement of Justice Sandra Day O'Connor. Roberts's nomination was the first Supreme Court nomination since Stephen Breyer's in 1994. On September 3, 2005, while Roberts's confirmation was pending before the Senate, Chief Justice William H. Rehnquist died. Two days later, Bush withdrew Roberts's nomination as O'Connor's successor and nominated Roberts to succeed Rehnquist as chief justice.[89]"

The point here is that it was a done deal. When the senate came back after recess they didn't have any choice but to confirm because Roberts was already seated and running the court by that time.

I understood what you were saying, but the political circumstances were not the same as the scenario you put forth. And quite frankly, Manchin aside, I think Biden is pissed off enough and vindictive enough to do nothing re. any appointment. He seems to have figured out that his own party is the enemy and if he hasn't Jill damn sure has.
