Technically they can make decisions that challenge the words of the law. 45 did so on multiple occasions in regards to immigration laws and was immediately struck down.

Sorry, those are rules. Law enforcement has always been up to the discretion of the individual enforcing it. There is no law preventing an officer from letting you go with a warning for really anything. They could go through that corner party and start asking for IDs. They know you aren't 21. They knew you were speeding. They broke up a fight. The exact same thing applies all the way up to the president. You know thats exactly how there wasn't a top to bottom house cleaning over that whole Gitmo and whatever the other site of torture was. Or hell Gitmo to this day. Every Bush, Obama, Trump and Biden have all violated the Constitution with that place.

The Democrats are doing that. Their actions enabled the 2016 fiasco, like sabotaging Bernie Sanders in favor of Hillary Clinton. Sanders would have beaten Trump, and therefore no President Trump. But no, it was Clinton or Trump as far as the DNC were concerned, just like it's Biden or Trump now.
The corporate Democrats still blame Ralph Nader for George W. Bush winning in 2000, despite Al Gore picking Joe Lieberman as his running mate, despite Gore alienating West Virginia and failing to win New Hampshire. Winning just one of either West Virginia or New Hampshire would have meant Florida not mattering. The corporate Democratic warmongers are utterly incapable of looking in the mirror and seriously asking themselves why they have lost ("It's Russia, you know. Look over there").

That makes zero sense, when the Obama administration didn't codify Roe v Wade when they controlled the presidency and both Houses of Congress. They used, and use, abortion as a culture war issue to distract people from corporate profiteering and worsening living standards for ordinary people. The corporate Democrats don't want the abortion issue settled, but as a continual cultural divide, the same as their Republican equivalents. More and more people are seeing through their BS.
