The Legally and Morally Flawed Case Against Trump​

Although we don’t yet know entirely how it will be structured, enough of the Manhattan District Attorney’s case against Trump has found its way into the public domain so that we know the general parameters. The centerpiece of the case is a misdemeanor charge under Section 175 for supposedly falsifying his business records. The theory is that Trump paid his former lawyer $130,000.00 in a series of reimbursements to Cohen and labeled them as legal expenses to conceal that the money was really to pay Adult Film Actress, Stormy Daniels for a nondisclosure agreement and that somehow this scheme violated federal election laws. From a legal perspective, this bizarre wielding of State prosecutorial power in pursuit of what is essentially an alleged federal crime is seriously flawed.

For starters, it is not a crime to be a philanderer, if in fact Trump did have an affair with Ms. Daniels. She has claimed publicly that there was no affair – but who knows. It is not a crime for Trump to pay so-called “hush money” either. I hate it when people call it that. It is a legal contract called a “nondisclosure agreement” and it is not in the least uncommon. Particularly for a celebrity who is a married man with many business interests. There are myriad reasons – unrelated to his Presidential Campaign – for Trump to pay the money to Ms. Daniels.

It’s worth noting that the Federal Elections Commission and the Department of Justice have already looked at all this and took no action back when it was fresh. Nevertheless DA Bragg is essentially trying to stuff a federal campaign finance crime into a state law business records charge. The business records case under Section 175 is a misdemeanor and the statute of limitations is two years. If DA Bragg manages to shoehorn an alleged violation of the federal campaign finance laws into the Section 175 charge – despite being a state DA and not a US Attorney – then the business records case becomes a felony and has a five-year statute of limitations. My iPhone tells me this is 2023 – nearly seven years after any such Section 175 business record crime would have occurred. So, the statute of limitations has clearly run. Nevertheless, I wait on pins and needles to see what whackado legal theory DA Bragg pulls out of his…..hat to claim the statute of limitations has somehow not expired.

There is no historical precedent for a prosecution of this nature against anyone, especially against a former President of the United States.

If you put some thought into how things could work out if Trump is indicted, it’s the same old same old. First the indictment and that process, perhaps 3 weeks out. Trump plead not guilty. It then proceeds to the selection of a prosecutor and trial judge. Then after some deliberation the trial judge establishes the trial dates. I would bet that all these events will take us well into the 2024 election season. Let’s just say for shits and giggles the trial starts around Mar. Apr. time frame, that would make it the third time the democrats get away with using the justice system to influence, interfere with either a presidential or midterm elections.
Democrats are pushing the limits of the law and decency toward the breaking point. One wonders where all of this will take us. The Deep State leftists who are behind this attack on our election process and the assault on our economy are evil people with evil intent. Now that the left and its constituency are ignoring the law to advance their agenda what happens when the rest of America decides to do the same? It won't be pretty.
 
team trump sent out an email to their 74 million marks, calling for signatures on petitions to protest his arrest and, no surprises here, panhandling for donations from $24 to $3,300. so, basically, a pay-to-sign for an arrest protestation. If he was genuine, they'd be looking for signatories only, not cash that will fall directly into trump's pudgy little hands.

Insider reports that Trump’s team sent out an email on the evening of March 20 to 74 million of his supporters requesting that they sign a petition to stop his alleged arrest, which is reportedly set to take place in New York. In the message, Trump’s team claims that the public is trying to cancel his supporters’ votes by attempting to imprison the father of five.
The email read, “They’re trying to intimidate YOU and cancel out YOUR vote! Which is why the Trump for President 2024 campaign is compiling millions and millions of petition signatures from Americans like you CONDEMNING these threats of a possible arrest.”
In addition to the message, the publication shared that individuals who signed the petition were asked to donate to Trump’s cause. Although it is unclear what that particular cause is, a screenshot image of the donation flyer showcased that Trump is trying to get free of what he describes as a “never-ending witch hunt.”

They don't enforce NY state law. They aren't going to be the arresting authority in the enforcement of a NY state warrant.

No I don't. That's the problem really. Whether its here on the GB, in the halls of Congress or in the media there is a clear difference in the way Liberal conduct themselves and how conservatives conduct themselves. IT forces you to take behavior that while bad isn't the worse and blow it up.

Pelosi ripped Trump's speech in half. Okay bad. We have two years running of MTG and Bobert treating the State of the Union like a comedy club act and heckling the host. Not to mention whoever shouted YOU LIE at Obama.

By contrast Bush once got a shoe thrown at him and for two weeks wee all cheered President Neo. Creepy love letters aside we were happy that North and South Korea's leaders had a face to face in the DMZ. This was a good thing and something we were willing to give credit for. Until he started siding with Putin over America which took all of two seconds we weren't but so pissed he was on good terms with Putin.
