So I don't do anything to put a age on my characters what so ever . But I have been rejected 2x the only reason stated is the under 18 rule. Do I have to put the automatic disclaimer that's posted by literotica in my story or what?

It’s not only mentioning age, it is anything that leads the reader to see it as underage, simple things like type of school, could it lead to a school year, activity, that is generally under 18. Activity on a school bus for example, where several school years are on the bus. It is a minefield. Putting a disclaimer helps but making the text as clean as possible is the way to go.
 
I once had a story tejected for underage because I mentioned pugtails and braces. A 40 year old mom was talking about a cartoon character, nothing sexual at all. I copied the telavant pasdge into the notes and explained and it passed.

Moderation seems to involve a combination of keyword search and skim reading; if you have something like "a sixteen-year-old bottle of wine" in there, that can cause an accidental rejection. If that's the case, you can just resubmit with a note saying "there are no under-age characters in this story" in the Notes field, and Laurel will read it more carefully.

Be aware that the site does take a fairly broad view of what counts as "sexual activity" (including masturbation, voyeurism, fantasy) and an "all characters are over 18" disclaimer may not get a pass if they're written as under-age. e.g. if the "pigtails and braces" example Salacious_Scribe mentioned had been a character having sex within the story, rather than just a side reference, that might have been rejected.
 
If any minors might see or hear of the sexual activity, that's a strike. 'Sex' also includes daydreams and masturbation, anything potentially erotic.

If some activity having happened is crucial to the plot then you can factually state it, but nothing that might be construed as at all erotic.

One of my characters is a whisky fan so I put in the Notes that all references to 12 year old, 15 year olds etc were to bottles of single malt whisky, and I've never had any story rejected. Even with most of my characters having had sex around the UK age of consent of 16.

I thought literotica bans everything that goes under 18. Had a story (under different username) that included people in the UK. Mentioned how a couple of 18 year olds were not virgins since a couple of years. Got rejected, then approved when I removed that line.

A disclaimer does nothing to solve a breach in the content on the under 18 rejection issue. What's causing the rejection (or the initial checker of the story thinks justifies rejection) is still there. Maybe what you'd written doesn't really breach the Web site policy on this. The sole submissions editor isn't really reading the story or, unfortunately, making a rejection call because she personally checked the issue out. But if a problem is still there, slapping a disclaimer on the top doesn't make it go away. The circumstance requires looking closely at the content and changing it (maybe taking a closer look at what you think is depicting underage sex or not) or inviting a closer check by the editor, Laurel, via bringing it up in the Notes box of a refiled story.
 
Its not just chronological age. Descriptions that sound as if underage. Wispy pubic hair, developing breasts, braces, pigtails etc...
