He wasn't sentenced to rape as a punishment, he was sentenced to prison for his creation of a hoax hate crime.

Prison rape isn't a new thing. It's disgusting, but just like in real life, it happens. The man does what they can to prevent it, but the prison population aren't the most model of citizens and they'll find a way. And if they let Jussie out for that reason, then they'll need to let everyone else out as well.

Not a very practical solution.

In the end, Jussie's trying everything he can to avoid being punished for his offenses. This is nothing new.
