I bet you're right.

I think, though, that there was a political calculation about this guy. First off, he is injured, and people naturally sympathize with that kind of damage. Secondly, he was a BLM protester, and local law enforcement have been bending over backwards not to provoke more riots.

So, he should be charged, especially considering that a court case determined that the person who injured him was in fear for his life. Seems like he's just going to get a pass.

Depending on the weapon, now that the statute has been properly interpreted the hapless prosecutor may have to rethink the application of that statute if it any relation to the methodology he used in applying it to KR.
