Quit being a dummy. Jerry Dunleavy is a well known and competent investigative reporter assigned to the DOJ. This is about Michael Sussmann lying to the FBI about his connection to the Hillary Clinton Campaign when he introduced the phony story about Trump Russian Collusion to the FBI:

Special counsel John Durham logged a second indictment in his investigation of the Trump-Russia investigators on Thursday.

A grand jury returned a 26-page indictment charging Michael Sussmann , a lawyer for Perkins Coie who had worked on behalf of Democratic clients numerous times, with intentionally lying to the FBI’s top lawyer in September 2016 about who he was working for when he passed along controversial allegations of secret communications between Russia’s Alfa Bank and the Trump Organization.

“Sussmann lied about the capacity in which he was providing the allegations to the FBI,” the indictment says. “Specifically, Sussmann stated falsely that he was not doing his work on the aforementioned allegations ‘for any client,’ which led the FBI General Counsel to understand that Sussmann was acting as a good citizen merely passing along information, not as a paid advocate or political operative. In fact … this statement was intentionally false and misleading because, in assembling and conveying these allegations, Sussmann acted on behalf of specific clients, namely, a U.S. technology industry executive at a U.S. internet company, and the Hillary Clinton Presidential Campaign.”

Baker testified in 2018 that Sussman, a former DOJ colleague, shared the Alfa Bank claims with him during a September 2016 meeting. Notes from DOJ official Bruce Ohr’s December 2016 meeting with Glenn Simpson show the Fusion GPS co-founder said the New York Times was wrong to doubt the story that Alfa Bank and the Trump Organization were communicating through secret servers.

In painstaking detail, Durham laid out in the indictment Thursday how Democrat superlawyer Michael Sussmann used Clinton campaign funds to construct a now-debunked memo and other evidence alleging that computer communications between a server at the Alfa Bank in Russia and the Trump Tower in New York might be a secret backdoor communication system for Trump and Vladimir Putin to hijack the 2016 election.

Sussmann delivered the package in mid-September 2016 — just weeks before Election Day as Trump and Clinton were locked in a tight race — to then-FBI General Counsel James Baker, even after the team of computer experts warned the theory was a "red-herring," according to the indictment.

And then Sussmann falsely told Baker, the prosecutors alleged, he was providing the information to the FBI solely as a good citizen, and not on behalf of any client.

In fact, Sussmann was working on behalf of a tech executive and the Clinton campaign and charged nearly all the work on the Alfa Bank narrative to the Democratic presidential campaign, including his meeting with Baker, the indictment stated.

Good article by a very able former federal prosecutor.

The indictment exposes a conspiracy which leads me to believe that Durham is going to indict several others who used the false narrative as a vehicle to attack the Trump Campaign. The politicized leadership of the FBI used it's resources to manipulate the FISC with false sworn affidavits to gain warrants in furtherance of the groundless FBI investigation, that kept the narrative in the news and influencing the public negatively towards the administration, thus diminishing the President's ability to govern. Which I believe became it's purpose after the election and laid the groundwork for the two baseless impeachment attempts. Which I believe fall within the scope of 18 USC 371, Conspiracy Against the United States. You can read in detail the criminal components that define this statute here:

Last week, the special counsel appointed to oversee the probe into the FBI's investigation of former president Donald Trump indicted Michael Sussmann, a lawyer for the 2016 Hillary Clinton presidential campaign. Republicans and Trump allies are optimistic about the latest development in John Durham's investigation but are still concerned that Attorney General Merrick Garland might halt the investigation to protect allies and even the president himself.

FBI notes appear to suggest that as vice president, Joe Biden played a role in the Democratic Party project to smear Trump as a Russian asset by raising the obscure, disused, 18th century statute the Logan Act as a possible vehicle for prosecuting Michael Flynn for speaking with the Russian ambassador to Washington — even after FBI case agents had cleared Trump's incoming national security adviser of wrongdoing.

And now Republicans are raising concerns that the judge appointed to the Sussmann case has too many conflicts of interest to preside over it fairly.

Current and former officials say that federal District Court Judge Christopher Cooper's professional and personal relationships with top Democrats and figures behind the FBI's Trump investigation should force his recusal. Cooper's wife, for instance, represents disgraced FBI lawyer Lisa Page, who oversaw the FBI's Trump probe.

What to make of the indictment by Special Counsel John Durham of former Clinton Campaign attorney Michael Sussmann, a one-time partner in the go-to-for-all-legal-needs Democrat Party law firm of Perkins Coie?

Typically, a “false statement” indictment will consist of a brief description of how the federal investigators came to ask the question, the answer given by the defendant which is alleged to be false, and what a truthful answer would have been.

If you want an example of what a typical such indictment might look like, it’s right there in Sussmann indictment — read paragraph 46:

Paragraphs 1 through 44 were not necessary to charge Sussmann. That makes what Durham returned a “speaking indictment.” It discloses information in a public document that would not otherwise be known if the indictment set forth only facts needed to meet the requirements of due process.

A “false statement” charge does not require a litany of factual allegations regarding the conduct and statements of the defendant and numerous third parties over the course of weeks or months leading up to the making of the false statement. In over 30 years of practice as both a federal prosecutor and a defense attorney specializing in federal cases, I’ve never before seen anything remotely resembling the Sussmann indictment in a single count “false statement” case.

Although John Durham has managed to get an indictment for Michael Sussmann as part of the investigation into the origin of the Federal Bureau of Investigation's (FBI) inquiry into the Trump campaign's ties with Russia, legal experts are still not impressed.

In fact, according to Business Insider, legal experts view the case Durham has built against Sussmann as "unusually — even remarkably — thin." Speaking to the publication, Randall Eliason, a former federal prosecutor and current law professor at George Washington University Law School, weighed in with his take on the case.

"Proving this case is going to be remarkably difficult," Eliason said of Durham's case. While Trump has adamantly insisted that the investigation would uncover a "deep state" conspiracy, that has yet to come to fruition.

Insider highlights two problems with Durham's case. The investigating prosecutor is said to only have one witness, The indictment is reportedly linked to a September 2016 conversation Sussmann had with former FBI general counsel, James Baker. At that time, Sussmann is said to have "shared digital information suggesting a possible back channel of communication between the Trump Organization and the Kremlin-linked Alfa Bank."

However, the FBI's investigation determined there was "'insufficient evidence' to support allegations of a secret communications channel with the Russian bank."

In addition to only having one witness, that witness' recall is vague. In 2018, during a hearing with the House Judiciary Committee, Baker claimed he could not remember some aspects of his meeting with Sussmann. He also claimed he did not pressure Sussmann for more information about the evidence he provided or its origin.

Jordan: Did you know at the time that he was representing the DNC in the Clinton campaign?

Baker: I can’t remember. I have learned that at some point. I don’t—as I think I said last time, I don’t specifically remember when I learned that. So I don’t know that I had that in my head when he showed up in my office. I just can’t remember.

Jordan: Did you learn that shortly thereafter if you didn’t know it at the time?

Baker: I wish I could give you a better answer. I just don’t remember.

Don't see how that would work as a scam. The sister ship would cost just as much money and they couldn't claim the insurance on it.

Overwhelming evidence of guilt but a conflicted Democrat jury protected it's own. Two or three Jurors were Clinton donors, the wife of the judge representing Lisa Page, another Juror's daughter on the same sports team as Sussman's daughter. What are the odds of this kind of a nexus in a city wide Jury trial. We saw this coming but hoped for justice to prevail. Meanwhile another Hillary Clinton conspirator goes free.
