Is fan art allowed on here?

I noticed that there is a "celebrities and fan fiction" category over on the stories section of this site, so it made me wonder if I could post the drawings I do myself of well known shows such as the Simpsons and Family Gut, etc.

Probably not, because the visual depictions of the originals would be copyright.

You have to own the copyright in any artwork uploaded to Lit - that is, your original work.

Presumably, one would not be able to do, say, "porn drawings" of Marge Simpson, because Marge Simpson is a copyrighted cartoon character, and if you draw a character and publish the character that looks like Marge Simpson, you are infringing the copyright.

You might try to argue it's a Fair Use, but I think that would be difficult.

You can find tons of examples on the Internet of Simpsons porn, but that doesn't mean it isn't copyright infringement. It just means people are getting away with it. That doesn't mean it would be allowed at Literotica.

But here's a twist on the question: what if you wanted to do porn drawings based on Lord of the Rings characters, or Twilight characters -- based on the written stories, not on the movies?

I think that would be OK (under the law, I mean -- Literotica's owner might prevent the publication of such drawings per her own rules, but that's another issue).

The author of Twilight has a copyright in her words. She doesn't have a copyright in somebody's imagined view of what Bella or Edward look like, clothed or naked. As long as the image isn't dependent on the movies in any way, I don't see how fanpic visual art of this sort would be a violation of the law in any way.

Open season, I'd say. It's the imagery that gets the copyright. You might not be able to portray "Legolas" but you could portray your own "elf".

There are several posts in the Adult Comics section based on copyright material, e.g.:

And at least one in Illustrated Stories:

So I'm not sure Literotica does ban fanart - it specifically allows fanfic so I'm not sure what the basis would be for handling visual stuff differently.

Simpsons, though, is specifically off limits, as are Harry Potter and Disney.

I should have been clearer.

In trying to answer these "what's allowed" questions it's easy to overlook that there are three distinct questions, and depending upon the specific subject matter the answers may be the same or completely different:

1. Does the law allow it?
2. Will I be able to get away with it as a practical matter, even if the law doesn't allow it?
3. Does Literotica prohibit it, even if the law allows it?
