Florida man Paul Hodgkins receives 8 months in prison, first Jan. 6 defendant sentenced on a felony charge

A Florida man became the first felon sentenced Monday for his role in the Jan. 6 insurrection at the U.S. Capitol, receiving eight months in prison and being ordered to pay $2,000 in restitution for a portion of the damage to the building.

Hodgkins, 38, of Tampa, faced sentencing guidelines of 15 to 21 months in prison after pleading guilty to obstruction of an official proceeding for interrupting Congress' counting of Electoral College votes. He spent 15 minutes in the Senate chamber, holding a flag for former President Donald Trump and taking pictures.

District Judge Randolph Moss called literally waving the flag for Trump an unmistakable sign of loyalty to a single person rather than the country and democracy.

“Although Mr. Hodgkins was only one member of a larger mob, he actively and intentionally participated in an event that threatened not only the security of the Capitol but democracy itself,” Moss said. "That is chilling, for many reasons."

Hodgkins had asked Moss for no prison time. Hodgkins said he had no plans to enter the Capitol when he traveled to Washington to attend Trump's rally earlier in the day, but that he got swept up in the march along Pennsylvania Avenue. Once inside the Capitol, he said he apologized to police officers for the trouble and he offered medical care to an injured rioter.

Not even, there is nothing illegal about a peaceful protest.

The only person who SHOULD be charged with anything from 1/6 is the cop who gunned down a peaceful protester.
 
The January 6th seditious attack on the U.S. Capitol was part of a Donald Trump (incompetently) planned coup against the United States. Until Donald Trump is charged and prosecuted in this case the answer to the question of whether or not he is being held above the law is "yes, thus far." There are a multitude of other instances of Trump corruption, criminality, sexual abuse, and treason that Donald Trump is currently floating above the law on. He needs to be prosecuted, convicted, and imprisoned for across-the-board criminal behavior.
 
Donald Trump is too stupid to plan anything. He was used by Putin. It is true he is still a Fascist traitor...as is anyone that supports him...but he will never be charged for the Jan 6th insurrection. Now...income tax evasion...or campaign finance laws....those are a given

We’re 6 months into the Biden Administration and I haven’t seen any hint of an effort to charge Trump with anything remotely related to the January 6th riot. Is it because Joe is too sleepy or because Merrick Garland is to too lazy? Or is it perhaps because they know there is no chance of winning a prosecution in a court of law?

With luck, he's convinced you not to get vaccinated as well--this after he not only has been vaccinated himself, but also, before that, caught Covid and would be dead now if not, as president, he got a $630,000 hospital fight to keep him alive.

They're not prosecuting the traitor in chief federally because that would only enhance his martyr status as a persecuted victim of the "deep state".

I'm fine with letting his rabid deplorable minions take the hits for their Orange God. After enough of them are jailed, and realize that the traitor in chief isn't lifting a finger to help them, they probably will lose faith in their cult leader. Once a charlatan loses the sucker's faith and confidence, the whole charade falls like a house of cards.

As if there would be some traitorious reason not to charge the people who so clearly by conduct and speech incited people to rebel against the authority of the United States government and the Congress execution on its constitutional duty.
 
Last time I fought a traffic ticket, I was found guilty by a judge, not my peers. Should I ask for a retrial?
