FBI agents arrested Aaron Mostofsky, 34, who is the son of Judge Shlomo Mostofsky, in New York Tuesday morning. He cried when he appeared in court and now faces up to 10 years behind bars.

The younger Mostofsky, who dubbed himself a 'caveman', has been hit with multiple charges, including theft of government property for allegedly stealing a police riot shield and bulletproof vest, unlawful entry and disorderly conduct, knowingly entering or remaining in any restricted building or grounds without lawful authority, and knowingly, with intent to impede government business or official functions, engaging in disorderly conduct on Capitol grounds.

If convicted on the theft of government property charge, Mostofsky faces a maximum of 10 years in prison.

Mostofsky was later seen leaving the courthouse clad in a windbreaker and Star Wars pajama pants

I truly don't understand why every rioter isn't charged with felony murder... particularly for every current and former law enforcement officer and all those who are or formerly served in the military. This was an attempted overthrow of democracy by many who swore an oath to serve and protect the public and the Constitution... working in concert and a law enforcement officer was killed. It's truly a "Capital" crime punishable by death.

"Felony murder is a legal rule that expands the definition of murder. It applies when someone commits a certain kind of felony and someone else dies in the course of it. It doesn’t matter whether the death was intentional or accidental—the defendant is liable for it. The rule is usually limited to felonies that are inherently or foreseeably dangerous to human life."

So I'm going to make a little prediction here... some of them will inevitably be charged with felony murder but not before January 21 because trump would individually pardon them. Fascist trump will be forced into a position to pardon all rioters beforehand and he will also attempt to pardon himself, his family, fascist Pence, his current and former cabinet members and advisors, and his entire WH staff. Fascist Pence can't invoke the 25th if he wants to be pardoned... so the congressional fascists will force the house to impeach and then do nothing in the senate. The fascists will try to flood the media with the lies that further pursuit of criminal behavior proves democrats don't want unity... instead what the lies do prove is the fascists don't want law and order and they surely never want to be held accountable and responsible for their own actions.

They are one of the very few I have on my ignore list after clearing it out. I have a pretty good idea who it is. I won’t repeat what they were saying. Thank you for calling them out as well, but I would be happy to not have to see their vile bigotry at all.

It's too early to know what the ultimate charges are. They initially charge at a lower level to get the person pinned down. Charges can be--and probably will be--added as the cases develop.

There's a lot of sorting out to do. Basic to this is whether the demonstration permit included the Capitol grounds (yes, demonstration permits were granted to this crowd, but if only for Lafayette Square, there can be charges for demonstrating at the Capitol, even from a distance, when it turned into a riot). If so--if demonstrating on the Capitol grounds was included in the permit--a vast number of those present aren't chargeable at all and delicate work is required to sort them out from those who committed crimes outside the Capitol. Anyone pinned down inside the Capitol building is, justifiably, toast legally. As is anyone they can show engaged in violence outside the building.

yeah, this is what the fbi/doj guys were saying yesterday... once those initial charges are laid, it opens up the avenues to broaden the charges.

i can't confirm about the grounds, but--surely--the very presence of those barriers the rioters pushed through would indicate that they weren't allowed in that restricted area.
