And as for Trump himself, it's not even in dispute that he gave that speech just before they marched down Pennsylvania Avenue in which he encouraged them to fight (and lied to them that he would be there with them, but that's beside the point). It's simply a matter of whether his remarks met the legal definition of instigating violence.
